THE COUNTY OF KERR )
This AGREEMENT made and entered into by and between KERR COUNTY, TEXAS, acting herein
by and through its Commissioner's Court, hereinafter called "COUNTY", and UPPER GUADALUPE
RIVER AUTHORITY, acting herein by and through its duly constituted Board of Directors,
hereinafter called "UGRA".
L4 I T N E S S E T H:
[dHEREAS, County has heretofore entered its ORDER establishing a construction permit
system and adopted regulations requiring permits for construction in flood plains areas having
such flood hazards, providing for the review of subdivisions, providing for administration
and enforcement of the regulations, and making provisions relating to construction within
the counties designated flood plains; and
WHEREAS, County has heretofore entered its ORDER adopting rules in Kerr County, Texas,
for private sewage facilities providing for the abatement and prevention of pollution or
injury to the public health in Kerr County, Texas; and
WHEREAS, pursuant to Article 4477-1 of Vernon's Texas Civil Statutes Annotated, provides
minimum standards of sanitation and health protection measures, which the County is desirous
of enforcing; and
j WHEREAS, County desires to utilize the services of the General P4anager of UGRA, as the
~I Administrator of each oŁ the foregoing, hereinafter called "Projects",

WHEREAS, UGRA has agreed with County that its General P~Yanager may act as the Administra-
for of the Projects, in addition to his other duties:
NOW, THEREFORE, KNO[4 ALL bIEN BY THESE PRESENTS, that the County for and in consideration
of the services to be rendered by UGRA in permitting its General Manager to serve as Adminis-
trator of each of the aforesaid Projects, hereinabove referred to, County agrees to pay to
~ UGRA, the sum of $72,900.00 for services to be rendered from February 1, 1981 through Decemb
31, 1931; payment to be made by the payment of $33,900.00 on February 1, 1981 and $39,000.00
due on July 15, 1981.
Thereafter, for the year 1982 UGRA shall submit a proposed budget to the County by
October 15, 1981, outlining the proposed costs and fees for the administration of the Project
for the year 1982. If the County approves the said proposed budget, then the payments to be
made to UGRA shall be due one-half (2) of the total proposed budget on January 15, 1982,
and the ocher one-half (1/2) due on July 15, 1982.
Thereafter, UGRA shall submit a proposed budget on or before October 15 of each calendar
year, and if said budget is approved by the County, the County shall make payments under this
Contract of one-half (1/2) of the total due on January 15 of each year, and the remaining
one-half (1/2) due on July 15 of each calendar year.
This agreement shall continue in full force and effect so long as the County approves
the budget for each succeeding year, or until mutually ternlinated by written agreement of
both parties, or until terminated as provided hereinafter.
Not withstanding anything contained herein to the contrary, it is expressly provided
that the County shall deduct from the payment due on July 15, 1981, and from all payments
thereafter a sum of money equal to the fees collected by UGRA during the preceding six
months under the provisions of the ORDERS above referred to. UGRA shall submit the total

amount of fees collected to the County immediately prior to each payment date.
It is agreed and understood that either party to this agreement may terminate the same

by giving the other party not less than ninety (90) days written notice.

NO. 14221 APPROVAL OF CLAIM OF JACK MINNEY EQUIPMENT FOR ONE USED STREET ROLLER
On this the 12th day of December 1980, upon motion made by Commissioner Guthrie, seconded
by Commissioner Speakmon, the Court unanimously approved the claim of Jack Minney Equipment,
for one used street roller in the amount of $250.00 and that the Auditor and Treasurer be
authorized to draw a voucher payable out of the General Road and Bridge Fund to Jack Minney
!~ Equipment.
