ORDER APPROVING COMPROMISE AND SETTLEMENT
IN CAUSE NO. 78-43-A, 216th DISTRICT COURT,
HOWELL vs KERR COUNTY
On this the 9th day of June, 1980 came on to be heard and
considered by the Court the matter of an agreed settlement negotiated
by legal counselfor Kerr County and Travelers Insurance Company
in Cause No. 78-~43-A, 216th District Court styled Howell vs
Kerr County and it appearing to the Court that such compromise
and settlement as negotiated is in the best interest of Kerr County
it is Ordered on Motion by Commissioner Guthrie second-
ed by Commissioner Speakmon and unanimously approved by the
Court that Kerr County approve and ratify the proposed settlement
a nd compromise and that a voucher be drawn on the General Fund
of Kerr County in the amount of $1, 200. 00 payable to Thomas S.
Terrell, Escrow, this being Kerr Countys one half of the total
settlement arrived at by legal Counsel.

RELEASE
We, the Undersigned CLARENCE EDWARD HOWELL, LETA BELLE
HOWELL and GORDON MORRISS, for and in consideration of the
sum of TWELVE HUNDRED FIFTY AND NO/100 DOLLARS ($1,250.00) paid to
Leta Belle Howell and Clarence Howell, and the sum of ELEVEN
HUNDRED FIFTY AND NO/100 DOLLARS ($1,150.00) paid to Gordon
Morriss, the receipt of which is hereby acknowledged, do
hereby RELEASE and DISCHARGE the COUNTY OF KERR, THE COMMISSIONERS'
COURT, ALL INDIVIDUAL COMMISSIONERS, who are presently on
the Court or in the future, and all of their respective
agents, servants and employees of and from any and all
claims, causes of action, damages, attorney's fees, medical
expense, and any other thing whatsoever arising or to arise
out of the existence of, operations at, or any thing else
whatsoever done, or not done at, on, about or near, the
County Yard in Ingram, Texas, located across the street from
the Howell's residence. Some of the claims and causes of
action being released are set forth in the pleadings in the
above styled and numbered cause.
This releases future injuries or disease which may
arise, or be claimed to arise, out of, future operations at,
or use of, the said County Yard, which operations or use are
not substantially different from those conducted in the
past.
