That portion of Rule 65.6 (formerly Rule .305), which defines a "buck deer". i i I ~; In disapproving the foregoing, it is the express intention of the Court to disapprove all portions of the aforesaid Statewide Proclamation for 1981-82 which would in any manner or by inference permit the lawful taking in Kerr County of buck deer not having at least one forked antler protruding through the skin, and it is the further intention of the Court that i' as a result of its action of disapproval of the foregoing provision of said Statewide Proclamalj- i! tion for 1981-82 a buck deer shall be defined in the same manner as defined for Kerr County in Statewide Hunting, Fishing and Trapping Proclamation 1977-78 in Section .007, Paragraph 3, ;, i which provision and definition shall remain in force and effect in Kerr County for the 1981- ~' ~~ II2 season pursuant to the provisions of House Bill No. 1893, Chapter 620, Acts of the 64th ' ,~ '„ Legislature Regular Session, which statutory authority is also the basis for the action taken !' herein. 2. Rule 65.23 (i) insofar as it would in any manner authorize the taking of antlerless white tailed deer during regular open seasons in Kerr County under its terms and provisions. 3. Rule 65.33 (1) A and B, including sub-paragraph 65.33 (1) (B) (i) and 65.33 (1) (B) (ii) which fixes the season and bag limit for white tailed deer in certain counties and which would provide for an "either sex" white tailed deer season with no permits required for the taking of antlerless deer in Kerr County. In disapproving the foregoing it is the express intention of the Court to provide for the taking of antlerless deer in Kerr County by permit only as was provided for in Statewide Hunting, Fishing and Trapping Proclamation 1979-80 in Section .332 (1) (A), which season and bag limit and requirement for antlerless deer permits shall remain in force and effect in Kerr County for the 1981-82 season pursuant to the provisions of applicable statutory law heretofore cited. 4. Rule 65.34 (b) which would establish a bag limit on javelina in Kerr County. "~ In disapproving the foregoing it is the express intention of the Court that the prior status of no closed season or bag limit on javelina be continued as heretofore. 5. Rule 65.46 (a) which would change the closing date of the turkey season. In disapproving the foregoing it is the express intention of the Court that the closing ', date of the turkey season shall remain the same as that for white tailed deer and as per regulations applicable to Kerr County under the 1980-81 proclamation. 6. Rule 65.46 (e) (1) which would provide a spring gobbler season for wild turkey in Kerr County. In disapproving the foregoing it is the express intention of the Court that the hunting of wild turkey in Kerr County shall remain subject to the same regulations as were in effect in Kerr County for the year 1980-81.
