Schreiner Bank, Kerrville, Texas, of collections and deposits and disbursements by her in her hands for the period from January 1st, 1981 and ending June 30th, 1981 and held on deposit in the County Clerk's Trust Fund in the amount of $16,703.43. It appearing to the Court that said report is in due form and should be approved. Motion made by Commissioner Lich, seconded by Commissioner Holland and unanimously approved by the Court. o-o-o-o-o-o-o-o-o-o N0. 14394 APPROVAL OF SEMI-ANNUAL PAYMENT TO UPPER GUADALUPE RIVER AUTHORITY AS PER PRIVATE SEWAGE FACILITY CONTRACT On this the 13th day of July 1981, upon motion made by Commissioner Holland, seconded by Commissioner Lich, the Court unanimously approved the semi-annual payment to Upper Guadalupe River Authority, in the amount of $33,461.00, as per Contract for private sewage facilities. It is ordered by the Court that the County Auditor and County Treasurer be authorized to draw a voucher on the General Fund in the above amount, payable to Upper Guadalupe River Authority. o-o-o-o-o-o-o-o-o-o N0. 14395 APPROVAL OF THIRD QUARTERLY PAYMENT TO THE KERR COUNTY TAX APPRAISAL DISTRICT On this the 13th day of July 1981, upon motion made by Commissioner Holland, seconded by Commissioner Guthrie, the Court unanimously approved payment to the Kerr County Tax Appraisal District, in the amount of $23,891.08, for the third quarterly payment of the 1981 amended budget of the Kerr County Appraisal District. It is ordered by the Court that the Auditor and County Treasurer be authorized to draw a voucher on the General Fund, payable to the Kerr County Appraisal District in the above amount. o-o-o-o-o-o-o-o-o-o N0. 14396 ORDER DEFERRING APPOINTMENT OF ELECTION JUDGES PENDING REALIGNMENT OF COUNTY ,_, COMMISSIONERS' PRECINCTS AND COUNTY ELECTION PRECINCTS ON THE BASIS OF 1980 CENSUS DATA On this the 13th day of July, 1981, came on to be heard and considered by the Court the matter of the appointment of presiding judges and alternate presiding judges of the various election precincts of Kerr County pursuant to the provisions of Article 3.01 of the d~ Texas Election Code, which appointments are for the purpose of designating election officials whose duty it is to conduct elections held at county expense; and it appearing to the Court that in order to implement a realignment of Kerr County election precincts on the basis of 1980 census data, it will be necessary to make substantial changes in the boundaries of certain Kerr County election precincts, which pending changes presently create uncertainties as to the precincts of residences of certain prospective appointees, it is ordered on motion by Commissioner Lich, seconded by Commissioner Speakmon, and unanimously approved by the Court that the appointment of election judges and alternates pursuant to the provisions of Article 3.01 of the Texas Election Code be deferred until subsequent to the final realignment of County Election precincts on the basis of 1980 census data after the approval of the Attorney General of the United States of the proposed precinct boundaries; and it is further ordered that all presiding judges and alternate presiding judges heretofore appointed by the 59 _. _ .~_~~ _ Commissioners' Court continue to serve on an interim basis pending further action by the Court. o-o-o-o-o-o-o-o-o-o j' N0. 14397 A RESOLUTION by the Commissioners' Court of Kerr County, Texas, approving agreements and resolution authorizing the issuance of revenue bonds of the ~ Kerr County Industrical Development Corporation relating to the financing j of industrial or manufacturing facilities for Kerr Publications, Inc. '' WHEREAS, on the 20th day of October 1980, the Commissioners' Court approved a memoradnum i ',. of agreement by and between the Kerr County Industrial Development Corporation (the "Issuer") ~' i I~ and Kerr Publications, Inc. (the "Company") pertaining to financing the costs of acquiring ' I~ and constructing facilities to be operated and maintained by the Company in its trade or ~, ii II business and used for manufacturing or industrial purposes by the Company (the "Project"); and ~. WHEREAS, final agreements in relation to financing the Project and a resolution adopted j'! d by the Board of Directors of the Issuer authorizing the issuance of its revenue bonds in the ~~ principal amount of $825,000 have been submitted to this Commissioners' Court for approval ~: '~ as required by Section 25 (f) of the Development Corporation Act of 1979 (Article 5190.6, !i ','; V.A.T.C.S.); and WHEREAS, the Commissioners' Court hereby finds and determines that the resolution of the Issuer authorizing the issuance of the Kerr County Industrial Development Corporation Industrial Development Revenue Bonds, Series 1981 (Kerr Publications, Inc. Project) in the principal amount of $825,000 and the agreements executed in connection therewith, should be approved, now, therefore, BE IT RESOLVED BY THE COMMISSIONERS' COURT OF KERB COUNTY, TEXAS: SECTION 1: That the resolution of the Board of Directors of the Issuer entitled as follows: "A RESOLUTION by the Board of Directors of the Kerr County Industrial Development ~ Corporation relating to the issuance of revenue bonds to be known as "KERR COUNTY INDUSTRIAL ': DEVELOPMENT CORPORATION INDUSTRIAL DEVELOPMENT REVENUE BONDS, SERIES 1981 (KERR PUBLICATIONS, INC. PROJECT)", dated May 1, 1981, fixing the details and providing for the payment and security of such bonds, approving and authorizing the execution of a Loan Agreement and Trust I Indenture in relation to the payment and security of such bonds and the rights of the holders of such bonds, making such Loan Agreement and Trust Indenture a part of this Resolution; making certain findings, covenants and declarations relating to such bonds and the issuance thereof; acknowledging the rights of the Corporation under the Loan Agreement and Note to be assigned to the Chas. Schreiner Bank, Kerrville, Texas, as trustee, under the Trust Indenture; and resolving other matters incident and related to the subject and purpose of '~ this Resolution." together with (i) a Trust Indenture from the Issuer to the Chas. Schreiner Bank, Kerrville, Texas, as trustee, dated as of May 1, 1981 (attached to said resolution as Exhibit "A") and (ii) a Loan Agreement by and between the Issuer and the Company, dated as of May 1, 1981 (attached to said resolution as Exhibit "B"), are hereby in all respects approved. SECTION 2: The approval herein given is in accordance with the provisions of Section 25 (f) of the Development Corporation Act of 1979, and is not to be construed as any under- , taking by Kerr County, Texas, and such bonds shall never constitute an indebtedness or pledge of the Issuer, Kerr County, Texas, or the State of Texas within the meaning of any constitutional or statutory provisions, and the holder of such bonds shall never be paid in whole or in part out of any funds raised or to be raised by taxation or any other revenues
