SPEAKMON BILLY JOE GUTHRIE, JR and the Court having duly opened, the following proceedings were had: N0. 14496 ACCEPTANCE OF PROPOSAL OF COVERT & SON ROOFING TO REPLACE HAIL DAMAGED ROOF ON THE AGRICULTURE EXHIBITION BUILDING On this the 26th day of October 1981, upon motion made by Commissioner Speakmon, seconded by Commissioner Guthrie, the Court unanimously approved that the Proposal of COVERT & SON ROOFING, to replace the hail damaged roof on the Agriculture Exhibition Building, in the amount of twenty six thousand nine hundred and sixty-eight dollars, ($26,968.00), be accepted as the lowest and best bid. o-o-o-o-o-o-o-o-o-o N0. 14497 ACCEPTANCE OF ROADWAY IN LIVE OAK ESTATES On this the 26th day of October, matter of acceptance of Denise Drive, to Plat thereof recorded in Volume 3, Commissioner's Precinct No. 1. Upon motion made by Commissioner unanimously approved that the clauses recorded in Volume N, Page 438 of the ESTATES, be rescinded and that Kerr C subdivision mentioned above. N0. 14498 ORDER AUTHORIZING DISBURSEP~fENT OF UNDISTRIBUTED BALANCES OF FUNDS IN CERTAIN COUNTY COURT CRIMINAL CASES FROM THE TRUST FUND OF THE COUNTY CLERK On this the 26th day of October, 1981, came on to be heard and considered by the Court the matter of authorizing the County Clerk of Kerr County to make disbursement of certain undistributed balance of funds in certain County Court Criminal Cases and it appearing to the Court that the seven hereinafter enumerated criminal cases which were originally heard between the years 1971 and 1976 have been dismissed from the Docket of the County Court of Kerr County on October 19, 1981 without further proceedings pursuant to Motions of the County Attorney and Orders of the County Court as recorded in the Minutes of the County Court' and that the hereinafter enumerated balances of funds in the said seven cases being held in the Trust Fund of the County Clerk of Kerr County totaling $166.00 cannot be reasonably distributed or disbursed under normal proceedures, it is Ordered on Motion by Commissioner Holland, seconded by Commissioner Speakmon and unanimously approved by the Court that the County Clerk be authorized to disburse the sum of $166.00 on deposit in the Trust Fund in the following cases directly to the County Treasurer of Kerr County and for deposit in the 1981, came on to be considered by the Court the a roadway in Live Oak Estates Subdivision, according Page 153, Plat Records of Kerr County, Texas, in Holland, seconded by Commissioner Speakmon, the Court stated in Order No. 11973 dated October 20, 1973, Commissioners' Court Minutes, in regard to LIVE OAK aunty Precinct No. 1, does accept the roadway in said o-o-o-o-o-o-o-o-o-o County Judge Commissioner Precinct No. 1 Commissioner Precinct No. 2 Commissioner Precinct No. 4 General Fund of Kerr County: DATE CAUSE COLLECTED N0. DOYLE BAIN FOR RIGHT OF WAY FOR LOOP 534 SECTION 3 r, On this the 26th day of October, 1981 came on to be heard and considered by the Court the matter of compensation to be paid J. Doyle Bain as compensation for his conveyance to ~ i the State of Texas of 4 parcels of land required for the construction of Loop 534, Section '! 3, from the Kerrville State Park to State Highway 16, which 4 parcels comprise a total of 1.110 acres of land out of Survey 146, W. C. Francis, and are designated as Parcels Nos. 7, l 8, 9B and 9B (E) of said right of way; and it appearing to the Court that an agreed amount of compensation has been arrived at, it is ordered on motion by Commissioner Holland seconded' by Commissioner Guthrie and unanimously approved by the Court that Kerr County offers to pay J. Doyle Bain the sum of $42,248.00 as compensation for land and damages for his conveyance ! to the State of Texas of the said 4 Parcels of Right of Way as aforesaid with the compensa- tion being prorated as follows and subject to the execution and delivery of a right of way deed as to each parcel: Parcel No. Acreage Amount 7 0.213 $ 8,410.00 8 0.383 $15,533.00 9B 0.340 $13,454.00 9B(E) 0.174 $ 4,851.00 ~~ Totals 1.110 $42,248.00 and it is further ordered that on approval for filing by the State Department of Highways ' and Transportation of the aforesaid 4 right of way deeds; and on final title approval a voucher shall be drawn in the amount of $42,248.00 on the Loop 534 Right of Way Fund payable to J. Doyle Bain provided, however, in the event there remain unpaid ad valorem taxes levied against the portion of W. C. Francis Survey No. 146 owned by J. Doyle Bain including 1981 ad- valorem taxes, Kerr County reserves the right to deduct the amount of such unpaid taxes and penalty and interest, if any, from the total compensation hereby offered and to pay the same to the taxing agencies concerned. o-o-o-o-o-o-o-o-o-o N0. 14500 APPROVAL OF REVISED AGREEMENT - U. S. FISH AND WILDLIFE SERVICE COOPERATING WITH TEXAS AGRICULTURAL EXTENSION SERVICE - TEXAS ANIMAL DAMAGE CONTROL ASSOCIATION, INC. AND KERR COUNTY On this the 26th day of October 1981, upon motion made by Commissioner Guthrie, second- ed by Commissioner Holland, the Court unanimously approved that the Field Agreement - U. S. Fish and Wildlife Service cooperating with Texas Agricultural Extension Service - Texas Animal Damage Control Association, Inc. and Kerr County, be approved and effective as of September 1st, 1981, Kerr County will pay $700.00 per month for Predatory Animal Control, as per revised agreement, payable to the TEXAS COOPERATIVE TRAPPING FUND. o-o-o-o-o-o-o-o-o-o COURT ADJOURNED OCTOBER 26th, 1981 at 11:40 o'clock A.
