MUENKER County Judge Commissioner Commissioner Commissioner Commissioner County Clerk Clerk of the Court of Ker Precinct No. 1 Precinct No. 2 Precinct No. 3 Precinct No. 4 & Ex-Officio Commissioners' r County, Texas and the following absent members: None constituting a quorum, and among other proceedings, passed the following order: There came on to be considered a Petition for Local Option Election to Legalize Bingo Games for Charitable Purposes as Authorized by the Bingo Enabling Act in Kerr County, Texas, requesting that a local option election be ordered in Kerr County, Texas, (said County, hereinafter for convenience referred to as "area"), in accordance with the terms and provision of the Bingo Enabling Act, for the purpose of submitting to the legally qualified voters of said area the determination of the issue described therein. There also came on to be considered the certificate of the County Clerk pertaining to said petition certifying therein that said petition is signed by the requisite number of qualified voters of said area in accordance with the terms and provisions of the Bingo Enabl ac r_. Notice of said election shall be given as required by Article 4.05 of the Texas Election Code and Article 29e, Texas Revised Civil Statutes. It appearing to the satisfaction of the Court that said petition was verified by the Clerk no later than the 30th day after it was submitted and the Clerk checked and verified to the Commissioners' Court that said petition complies with all the terms and provisions of the Bingo Enabling Act and is signed by the requisite number of qualified voters of said area as required by the Bingo Enabling Act and that said petition is otherwise in conformity with the law, and that no election on the same issue has been held in said area within a period of two years prior to the date fixed for holding the election herein provided. THEREFORE, BE IT ORDERED BY THE COMMISSIONERS' COURT That an election to be held in Kerr County, Texas on the 16th day of January, 1982, which date is not later than 60 days after the date that the officer responsible for certify- ing a petition has certified that the petition is valid in accordance with the terms and pro- visions of the Texas Bingo Enabling Act for the purpose of submitting to the legally qualified voters of said area, the determination of the following issue, to-wit: FOR Legalizing Bingo Games for }C,haritable Purgposes as Authorized R~rrh~ount~~ Eexasing Act in AGAINST That said election shall be held in such consolidated Election Precincts and by such persons as shall be designated by the Commissioners' Court by separate order entered into the Minutes of the Court. „~ The polls at each of the designated polling places shall on said election date be open from 7:00 o'clock a.m. to 7:00 o'clock p.m. The ballots for said election shall have printed thereon at the top thereof the words "Official Ballot", and shall also have printed thereon beneath the words "Official Ballot" the following instruction note: "Place an 'X' in the square beside the statement indicating the way you wish to vote." Said ballot shall also have printed thereon the proposition appropriate to this election in the exact language stated in Section 8 of the Bingo Enabling Act, to [ait: Legalizing Bingo Games for FOR Charitable Purposes as Authorized by the Bingo Enabling Act in Kerr County, Texas AGAINST Paper ballots shall be used and each voter shall vote on the issue hereby submitted by placing an 'X' or other clear mark in the square beside the statement indicating the way he .... wishes to vote on each proposition. However, it is specifically provided that the election officers shall not refuse to count a ballot because of the voter's having marked his ballot by scratching out the statement of propositions for which he does not wish to vote. None but qualified voters of the above named area shall be allowed to vote at said election. Said election shall be conducted according to•the provisions of the Texas Bingo Enabling Act and Election Codes as may be applicable thereto and within 24 hours after said election, the officers holding said election shall make returns thereof to this Court as required by law. Notice of said election shall be given as required by Article 4.05 of the Texas Election Code and Article 29e, Texas Revised Civil Statutes. Absentee voting for said election shall be conducted by the County Clerk in accordance with the terms and provisions of the Texas Election Code. Said place for absentee voting shall remain open for at least eight hours on each day for absentee voting which is not a Saturday, a Sunday, or an official State holiday, beginning on the 20th day and continuing through the 4th day preceding the date of said election. Said place of voting shall remain open between the hours of 8 o'clock a.m. and 5 o'clock p.m. on each day for said absentee voting. It is further found and determined that written notice of the date, hour, place and subject of this meeting was posted on the bulletin board located at a place convenient and readily accessible to the general public at all times in the County Courthouse at Kerrville, Texas, at least 72 hours preceding the scheduled time of this meeting and that all of the terms and provisions of Article 6252-17, Texas Revised Civil Statutes, have been complied with. The above Order being read, it was moved by Commissioner Holland and seconded by Commis- sinner Lich that same do pass. Thereupon, the question being called for, the following members of the Court voted AYE: County Judge, Julius R. Neunhoffer, Commissioner Fred Holland, Commissioner Frank L.
