ORDER N0. 14541 ORDER FOR LOCAL OPTION ELECTION TO LEGALIZE BINGO GAMES FOR CHARITABLE PURPOSES AS AUTHORIZED BY THE BINGO ENABLING ACT IN KERR COUNTY, TEXAS THE STATE OF TEXAS X COUNTY OF KERR X On this the 14th day of December, 1981, the Commissioners' Court of Kerr County, Texas, convened in regular session open to the public, at the regular meeting place thereof at the Courthouse in Kerr County, Kerrville, Texas, with the following members of the Court present, to wit: JULIUS R, NEUNHOFFER , FRED HOLLAND , FRANK L. SPEAKMON , VICTOR LICH , BILLY JOE GUTHRIE, JR., EMMIE M. MUENKER , County Judge Commissioner Commissioner Commissioner Commissioner County Clerk Clerk of the Court of Ker Precinct No. 1 Precinct No. 2 Precinct No. 3 Precinct No. 4 & Ex-Officio Commissioners' r County, Texas and the following absent members: None constitutix~ a quorum, and among other proceedings, passed the following order: There came on to be considered a Petition for Local Option Election to Legalize Bingo Games for Charitable Purposes as Authorized by the Bingo Enabling Act in Kerr County, Texas, requesting that a local option election be ordered in Kerr County, Texas, (said County, hereinafter for convenience referred to as "area"), in accordance with the terms and provisions of the Bingo Enabling Act, for the purpose of submitting to the legally qualified voters of said area the determination of the issue described therein. There also came on to be considered the certificate of the County Clerk pertaining to said petition certifying therein that said petition is signed by the requisite number of qualified voters of said area in accordance with the terms and provisions of the Bingo Enabling Act. Notice of said election shall be given as required by Article 4.05 of the Texas Election Code and Article 29e, Texas Revised Civil Statutes. It appearing to the satisfaction of the Court that said petition was verified by the Clerk no later than the 30th day after it was submitted and the Clerk checked and verified Legalizing Bingo Games £or FOR Charitable Purposes as Authorized by the Bingo Enabling Act in Kerr County, Texas AGAINST Paper ballots shall be used and each voter shall vote on the issue hereby submitted by placing an 'X' or other clear mark in the square beside the statement indicating the way he wishes to vote on each proposition. However, it is specifically provided that the election officers shall not refuse to count a ballot because of the voter's having marked his ballot by scratching out the s~tement of proposi- tions for which he does not wish to vote. None but qualified voters of the above named area shall be allowed to vote at said election. Said election shall be conducted according to the provisions of the Texas Bingo Enabling Act and Election Codes as may be applicable there- to and within 24 hours after said election, the officers holding said election shall make returns thereof to this Court as required by law. Notice of said election shall be given as required by Article 4.05 of the Texas Election Code and Article 29e, Texas Revised Civil Statutes. Absentee voting for said election shall be conducted by the County Clerk in accordance with the terms and provisions of the Texas Election Code. Said place for absentee voting shall remain open for at least eight hours on each day for absentee voting which is not a Saturday, a Sunday, or an official State holiday, beginning on the 20th day and con- tinuing through the 4th day preceding the date of said election. Said place of voting shall remain open between the hours of 8 o'clock a.m. and 5 o'clock p.m. on each day for said absentee voting. It is further found and determined that written notice of the date, hour, place and subject of this meeting was posted on the bulletin board located at a place convenient and readily accessible to the general public at all times in the County Courthouse at Kerrville, Texas, at least 72 hours preceding the scheduled time of this meeting and that a1I of the terms and provisions of Article 6252-17, Texas Revised Civil Statutes, have been complied with, The above Order being read, it was moved by Commissioner Holland and seconded by Commissioner Lich that same do pass. Thereupon, the question being called for, the following members of the Court voted AYE: County Judge, Julius R, Neunhoffer, Commissioner Fred Holland, Commissioner Frank L. 5peakmon, Commissioner Victor Lich and Commissioner Billy Joe Guthrie, Jr., and the following members voted N0: None, Whereupon the Order was declared to have been unanimously approved, PASSED, APPROVED AND ADOPTED this the 14th day of December, 1981.
