ORDER N0. 14244 ORDER SETTING COUNTY AND PRECINCT OFFICIALS ON SALARY BASIS On this the 12th day of January 1981, at a Regular Term of the Commissioners' Court, with a quorum being present, there came on for consideration the matter of compensation of various County and Precinct Officials of Kerr County, Texas, for the year 1981, as provided for in Article 3912e, Section 6, R. C. S. of Texas. And it appearing to the Court that Kerr County has a popula- tion of less than 20,000 inhabitants, according to the last Federal Census and that the interests of the County would be best served if the County Officials and Precinct Officials of Kerr County be paid on a salary basis as provided by law, for the year 1981. Upon motion duly made by Commissioner Holland seconded by Commissioner Guthrie and unanimously approved by the Court, it is ordered that the County Officials and Precinct Officials of Kerr County be paid on a salary basis as provided by law, for the year 1981. It is further ordered by the Court that the Clerk of the Court prepare a certified copy of this order and send same to the Comptroller of Public Accounts in Austin, Texas. This is needed to determine the bases for the payment of money to your county officers and until it is received, this department cannot pay either your county or your county officers any money. The above request is provided for in TEX. REV. CIV. STAT. ANN., Art. 3912e, §2, which states the Commissioner's Court of each county in the State of Texas, at its first regular meeting in January of each year, shall determine if their ~rec~nct officers (excluding public weighers and registrars of vital statistics) shall be paid on a salary or fee basis. In counties having a population of less than twenty thousand (20,000) inhabitants according to the last federal census, the Commissioner's Court, by its order, determines whether its county officers (excluding county surveyors, registrars of vital statistics and notaries public) shall be compensated on a salary basis or on the basis of fees earned by them in the performance of their official duties.
