On this the 16th day of September 1981, upon motion
made by Commissioner Holland, seconded by Commissioner
Lich, the Court unanimously approved a Sub-lease
Agreement by and between Dugosh Aircraft Service Co.,
Inc., Sub-Lessor and the City of Kerrville and Kerr
County, Texas, Sub-Lessee and a Lease Agreement between
the City of Kerrville and County of Kerr, Lessor and
the U. S, Government, Lessee, leased premises described
as follows: A space 8 ft. by 8 ft. in the southwest
corner of the Dugosh "T" hangar located on Kerrville
?'funiciDal Airport; and a land area 3 ft. by 3 ft, for
an antenna pole.

:ATV OF HERR VILLE, TEXAS
The above is being done by the FAA in order to place radio
communications at the airport, and this is recommended by
the Joint Airport Eoard. In the interest of time and urgency,
we have given tentative approval so that the FAA may be
allowed to begin the work. Eoth Mayor Jennings and Judge
Neunhoffer have agreed that we could give this oral approval
and place the items on the next available agenda of the two
governing bodies.

Enclosed for your consideration are the original and three copies of the
referenced lease written to cover an 8 ft, by 8 ft. space in the southwest
corner of the Dugosh "T" hangar and a 6 ft. by 6 ft. land area for installation
of a Single Frequency Outlet (SFO) at Kerrville Municipal Airport.
As discussed in our telephone conversation June 11, 1981, a Federal Aviation
Administration (FAA} work crew is to accomplish all modifications regarding
[he SFO and Kerr County and 'the City of Kerrville are to lease the space and
land area to FAA at no cost except for electricity. We have computed
electricity at $15.00 per month based on a maximum of 250 kWh usage per month
at $.06 per kWh.
Tf this lease is acceptable, please have all copies dated and executed, have
the Corporate Certificates completed, and return the original and two copies
to this office to the attention of the Real Estate and Utilities Branch,

Indemnity Agreement
Sub-Lrssoe agrees to indemnify and hold Sub-Lessor and the
J~ro?»rt, of Sub-Lessor, in~-luding the leased premises, free and
liarril~~ss from any and all liak;ility for injury to or death of any
person, including Sub-Lessee and employees of Sub-Lessee, or for
damay~ to property arising from th+~ use and occupancy of the
leased premises by Sub-Lessee or from the act or omission of any
person or. persons, including Sub-Lessee and employees of Sub-
Lesse~~, in or about the leased premises with the express or
implied consent of Sub-Lessee.
Imprc;ements
Sub-Lessee shall be entitled (1) to enclose said 8' x 8'
porti~~n of. the leased promises provirie•~l that 'in the event of such
enclosure, Sub-Lessee cuts off S•~rb-L,essor's access to and from
the e~:terior door situated in the southwest c~;rner of said Dugosh
T Hanger, Sub-Lessee agrees to insrall, at its sole cost and
expense, a second exterior door comparable to the exterior door
currently in place in the Dugosh T Hanger to provide Sub-Lessor
with egress and ingress to and from the southwest corner of said
hanger; (2) to install pan antenna on said 3' x 3' portion of said
leased premises next. to said Dugosh T Hanger provided that same
shall be installed in accordance with FAA specifications and any
local Kerrville-Kerr County Airport specifications and regulations.
All such improvements constructed, built or placed on the
leased premises iiy Sub-Lessee, except f.or any radio and auxiliary
e~lui,~ment theref~~ antennas and other similar equipment, shall
become the. property of the Sub-Lessor and remain on the leased
premises at the expiration of this Sub-Lease.
Condition of Premises
Sub--Lessee stipulates that he has examined the leased
premises as well as all buiL3ings and improvements located thereon
and they are all, a' the date of this lease, in good order,
repair, and in a safe and clean condition.
Assignment and Subletting
Sub-Lessee shall not assign this lease nor sublet the
lease~_i premises or any interest therein without first obtaining
the o.ritten consent of Sub-Lessor., except that Sub-Lessee may
sub-lease to the FAA without such consent.
Time of Essence
Time is expressly declared to be of the essence of this sub-
lease.
F3inding of Fleirs and Assigns
Subject to the provisions of this sub-lease against assignment
of the Sub-Lessee's interest hereunder, all provisions of this
sub-leas shall extend to and bind, or inure to the benefit not
only of the t,arties hereto but to each and every one of the
heirs, executors, representatives, successors, and assigns of
Sub-Lessor or Sub-Lessee.
Texas Law to Apply
'Phis agreement shall be construed under and in accordance
with the laws of the State of Texas, and all obligations of the
parties hereunder are performable in i<err County, Texas.
Prior Agreements Superseded
This agreement constitutes the sole and only agreement of
the parties hereto and supersedes any prior understandings or
written or oral agreements between the parties respecting the
within subject matter.
IN WI'PNESS WHEREOF, the undersigned Sub-Lessor and Sub-
Lessee hereto execute this agreement as of the day and year first
