~~a~~i STATE OF TEXAS X X COUNTY OF KERR X ORDER DECLARING RESULTS OF AN ELECTION HELD IN THE TOWN OF INGRAM, JUNE 6, 1981 WHEREAS, an election was duly held in the town of Ingram on the 6th day of June, 1981, to determine whether the hereinafter described territory should be incorporated for municipal purposes to be known as the City of Ingram, and returns of said election duly made and it appearing from said returns that a majority of the votes were cast at said election in favor of incorporation, there being 294 votes for incorporation, and 21 votes for no incorporation. IT IS THEREFORE, ADJUDGED AND DECREED that said election resulted in favor of such incorporation; and I, JULIUS R. NEUNHOFFER, County Judge of Kerr County, Texas, do hereby declare the inhabitants of said territory hereinafter described as duly incorporated for municipal purposes to be known as the City of Ingram. The territory so incorporated is described in Exhibit "A", attached hereto and made a part hereof for all purposes. An actual survey of the boundaries of the City of Ingram shall be made accord- ing to the boundaries designated on Exhibit "A" and recorded pursuant to Article 971 of the Revised Civil Statutes of Texas by act of the officials of the City of Ingram following their election. This order is made and entered upon the records of the commis- sioners' court of Kerr County, Texas, this the ~ day o , 1981, and a certified copy of the same, together with Exhi "A" of said territory incorporated, as well as a copy of the field notes of the actual survey, shall be recorded in the proper records of deeds of said Kerr County, Texas. OEHLER 209 votes For Councilperson VERNON J. BURNS 197 votes EDWARD LANGE 194 votes MONROE SCHLABACH 120 votes BRUCE KIMBROW 107 votes JOSEPH W. ALLEN 98 votes DONALD WILLIAMS 98 votes J. D. SCHAEFER 68 votes LARRY V7ARREN 67 votes GENE RUDD 58 votes JIM RICKHOFF 17 votes For P4arshal: CHARLIE LEE 205 votes and, WHEREAS, there being a tie vote between JOSEPH W. ALLEN and DONALD WILLIAMS the said election as the foregoing named persons is hereby declared void; and WHEREAS, the County Judge has considered the returns of said election held on the 8th day of August, 1981; and WHEREAS, it appears to the said County Judge, and the County (1 Judge so finds, that the said election was in all respects lawfully held; and, WHEREAS, the results of said election have been tabulated and are hereby certified and that such tabulation and canvass is correct; IT IS, THEREFORE, ORDERED by the County Judge of Kerr County, Texas: That the tabulation of votes cast in the election held on the 8th day of August, 1981, made by the Presiding Judge of said election and certified by the County Judge of Kerr County, Texas, as shown be and the same is hereby adopted as the official tabula- tion of the votes cast in said election and that said tabulation be filed and recorded in the Official Records of Kerr County, Texas, as the official canvass of said election. That the official canvass of the returns of the said election reflects that the following persons were duly elected as mayor, councilperson, and city marshal as shown below: Mayor: DONALD C. OEHLER Council Member: VERNON J. BURNS EDWARD LANGE MONROE SCHLABACH BRUCE KIMBROW City Marshal: CHARLIE LEE There is shown to be a tie vote for the fifth position on the City Council, the said tie vote being between JOSEPH W. ALLEN and DONALD WILLIAMS, thereby necessitating a run-off election, in com- pliance with the terms of the State law. That the said JOSEPH W. ALLEN and DONALD WILLIAMS have entered into a written agreement by and between themselves, whereby the parties agree to abide by the toss of a coin in order to determine which of the said persons shall be elected to the fifth position on the City Council of the City of Ingram. The said coin toss having been conducted in the presence of the said County Judge of Kerr County, Texas, on August 27, 1981, and under the terms of the written (2 agreement between JOSEPH W. ALLEN and DONALD WILLIAMS whereby the parties agreed that should the coin toss show "Tails" that the said JOSEPH W. ALLEN would be elected to the City Council of the City of Ingram; and should the said coin toss show "Heads" that the said DONALD WILLIl~P4S would be elected to the City Council of the City of Ingram and that the results of said coin toss showed "Heads", thereby breaking the tie vote between the said JOSEPH W. ALLEN and DONALD WILLIAMS and having the effect of electing the Said DONALD WILLIAMS as a member of the City Council of the City of Ingram; thereby obviating the necessity of a run-off election.
