M., in the City of Kerrville, Texas, a SPECIAL SESSION of Commissioners' Court, with the following members present: JULIUS R. Commissioner Precinct No. 4 and the Court having duly opened, the following proceedings were had: N0. 14588 ORDER APPROVING LEASE PURCHASE AGREEMENT FOR THREE JOHN DEERE MOTOR GRADERS On this the 26th day of January, 1982 came on to be heard and considered by the Court the matter of approving three lease purchase agreements for three new John Deere Motor Graders for use by the Commissioners of Precincts 1, 2 and 4; and it appearing to the Court after due consideration that the aforesaid lease purchase agreements would provide the most economically feasible means of replacing three old motor graders which have become uneconomical to retain in use due to age and wear, it is ordered on motion by Commissioner Holland, seconded by Commissioner Guthrie and unanimously approved by the Court that the following three lease "r purchase agreements between Kerr County and the John Deere Industrial Equipment Company be approved and that the County Judge be authorized to sign the same on behalf of Kerr County: 1. A four year lease purchase agreement for a John Deere Model 670A Motor Grader for use of the Commissioner of Precinct one, including the trade-in of a used Caterpillar t•Iotor Grader Serial No. 68E 639; 2. A four year lease purchase agreement for a John Deere Model 570A Motor Grader for use of the Commissioner of Precinct Two, including the trade-in of a used Caterpillar Motor Grader, Serial No. 346608. year 3. A four lease purchase agreement for a John Deere Model 670A Motor Grader for use of the Commissioner of Precinct Four, including a trade-in of a used Caterpillar Motor Grader ~/,~, Serial No. 3U6607; ~" and it is further ordered that upon delivery of each individual motor grader and upon its final acceptance by the Commissioner of the precinct concerned, the Auditor and the Treasurer _ shall draw vouchers on the General Road and Bridge Fund for the first six months lease payment' of each motor grader as follows, with the vouchers being payable to John Deere Industrial Equipment Company: For each Model 670A Motor Grader, $9,816.48 For the Model 570A Motor Grader, $8,?_29.20 (Lease Purchase Agreements are on file, but not recorded) o-o-o-o-o-o-o-o-o-o N0. 14589 ORDER APPROVING TAX COLLECTION CONTRACT WITH HUNT IPdDEPENDENT SCHOOL DISTRICT On this the 26th day of January 1982, upon motion made by Commissioner Guthrie, seconded by Commissioner Holland, the Court unanimously approved a Tax Collection Contract, beginning February 1, 1982, by and between the County of Kerr, acting by and through its Commissioners' Court and Hunt Independent School District, acting by and through its Board of Trustees; TAX COLLECTION CONTRACT This Tax Collection Contract made and beginning on February 1, 1982, by and between the ...tl County of Kerr, acting by and through its Commissioners' Court, and Hunt Independent School District, acting by and through its Board of Trustees: 1. Term. This contract shall begin on February 1, 1982, and shall terminate on January 31, 1986, unless sooner terminated as provided herein below. 2. Tax Collections. The County agrees to collect on behalf of the School District all ad valorem taxes, panalties and interest due, or which may become due to the School District during the time this contract is in effect" The obligation of the County hereunder is to bill and collect current and delinquent taxes, penalties and interest, but the obligation hereunder does not include the obligation to appraise properties nor to assess them. During the term of this contract it is expected that such appraisal and assessment duties will be accomplished by the Kerr County Tax Appraisal District. 3. Records. The School District, without further cost, shall, at any time, be permitted to inspect and copy all records, including appraisals, assessments, bills, statements, computer tapes, any and all other material in the possession of the County in any way per- taining to the appraisal and assessment of the District's properties and the billing and collecting the District's taxes, penalties and interest. In the event of the termination of this contract, the School District shall be entitled to have all such records and materials, or copies thereof, turned over to the District. 4. Termination. Either party may terminate this contract as of January 31 of any calendar year by giving written notice of such termination prior to September 1 of the pre- ceding calendar year. 5. Disagreement on Collection of Taxes. In the event that the County elects not to tax certain properties and the School District elects to tax such properties, then the Y.err County Tax Collector shall be obligated to collect such taxes on behalf of the School District, or the School District at its election may collect such taxes on its own. 6. Compensation. The County, as compensation for the obligations assumed hereunder, shall be paid one per cent (1%) of the current and delinquent ad valorem School District taxes, penalty and interest actually collected on behalf of the School District. -1- 7. Unusual Litigation. In the event that litigation arises with regard to the anpraisal, assessment, billing or collection of any School District tax (other than tax delinquency suits), then both the County and the School District, if both are parties to such litigation, shall bear their own respective attorney's fees and expenses, provided however that any legal proceedings brought against the Kerr County Tax Collector only that are a result of this Tax Collection Contract shall be defended solely at the School District's expense. 8. Reports. All reports required by law to be prepared shall be included within this agreement. 9. School District. All taxes, penalties and interest collected for the School District shall each be deposited into a special account, separate and apart from any other account. On a weekly basis taxes collected for the District, whether taxes, penalties or interest (less compensation to the County) will be deposited in the District's designated depository bank in the appropriate accounts of the District. 10. Interest and Penalty. It is understood that interest and penalty shall be charged " as provided by law. EXECUTED by the Hunt Independent School District on this the 19th day of January, 1982.
