SMITH, COUNTY TREASURER OF KERR COUNTY, TEXAS, FOR APPOINTMENT OF JODY KAY VANICEK, AS DEPUTY COUNTY TREASURER OF KERR COUNTY, TEXAS On this the 12th day of July 1982, upon motion made by Commissioner Speakmon, seconded by Commissioner Lich, the Court unanimously approved the Application of Dorothy H. Smith, County Treasurer of Kerr County, Texas, for appointment of Jody Kay Vanicek as Deputy County Treasurer, effective July 19th, 1982, at a salary of $8,880.00 per annum ($740.00 per month), effective the date of her qualification, payable out of Officers Salary Fund. o-o-o-o-o-o-o-o-o-o N0. 14728 ORDER DISAPPROVING PORTIONS OF STATEWIDE HUNTING AND FISHING PROCLAMATION FOR 1982-83 On this the 12th day of July, 1982 came on to be heard by the Commissioners' Court of ', Kerr County, sitting at its regular July, 1982 term and being a regular meeting occurring more than 5 days subsequent to May 13, 1982, the matter of approval and/or disapproval of the provisions of Statewide Hunting and Fishing Proclamation for 1982-83 as adopted by the Parks ~! and Wildlife Commission of the State of Texas on May 13, 1982, and after due consideration by ~ the Court, it is ordered that those portions of said Proclamation not hereinafter disapproved by specific reference or by indirect referrals are deemed to be approved, and that the follow- ing portions, provisions and sections of said Statewide Proclamation for 1982-83 are hereby disapproved pursuant to the Court's action on the hereinafter specifically grouped sections of said Proclamation, to-wit: ~~~~~ I. Rule 65.46 (e) (1) which would provide a spring gobbler season for wild turkey in Kerr County. On motion by Commissioner Speakmon, seconded by Commissioner Guthrie, the foregoing provision is disapproved by a majority vote of the Court as follows: Voting "aye" Commissioners Lich, Guthrie and Speakmon and Judge Neunhoffer. Voting "no": Commissioner Holland. In disapproving the foregoing it is the express intention of the Court that the hunting of wild turkey in Kerr County shall remain subject to the same regulations as were in effect in Kerr County for the year 1981-32. II. Rule 65.33 (1) (B), Rule 65.33 (1) (B) (i), Rule 65.33 (1) (B) (ii), Rule 65.33 (1) (B) (iii), together with Rule 65.27 and Rule 65.33 (1) (A) to the extent that it would affect Kerr County. On motion by Commissioner Guthrie, seconded by Commissioner Lich, and unanimously approved by the Court the foregoing rules are disapproved insofar as they could either direct ly or indirectly affect Kerr County and in any manner establish an "either sex" white tailed deer season in Kerr County or in any way authorize the taking of antlerless white tailed deer in Kerr county other than by permit issued to individual landowners or their agents by the Department pursuant to procedures used in Kerr County in the year 1981-82 and in prior years. In disapproving the foregoing it is the express intention of the Court to provide for the taking of antlerless deer in Kerr County by permit only as was provided for in Statewide Hunting, Fishing and Trapping Proclamation 1979-80 in Section .332 (1) (A) which season and requirement for antlerless deer permits shall remain in force and effect in Kerr County for the 1982-83 season pursuant to the provisions of Section 61.202 of the Texas Parks and Wild- life Code, which statutory authority is also the basis for the action taken here. III. Rule 65.34 (b) which would establish a bag limit on javelina in Kerr County. On motion by Commissioner Speakmon, seconded by Commissioner Guthrie, and unanimously approved by the Court the foregoing rule is disapproved. In disapproving the foregoing, it is the express intention of the Court that the prior status of no closed season or bag limit on javelina in Kerr County be continued as heretofore. IV. Rule 65.46 (B) which would change the closing date of the turkey season. On motion by Commissioner Guthrie, seconded by Commissioner Speakmon and unanimously approved by the Court the foregoing rule is disapproved. In disapproving the foregoing it is the express intention of the Court that the closing date of the turkey season shall remain the same as that for the white tailed deer and as per regulations applicable to Kerr County under the 1980-81 proclamation. The foregoing order was considered and acted on by the Court in five separate portions as per individual. votes as hereinabove set forth this the 12th day of July, 1982. o-o-o-o-o-o-o-o-o-o
