ORDER N0. 14859 CONTRACT BETWEEN KERR COUNTY AND KERR COUNTY APPRAISAL DISTRICT FOR OFFICE SPACE TO BE PROVIDED BY KERR COUNTY TOGETHER WITH CERTAIN ADDITIONAL SERVICES PURSUANT TO THE AUTORITY OF ARTICLE 4413(32c) INTERLOCAL COOPERATION ACT On this the 13 day of December, 1982, the Kerr County Appraisal District (hereinafter referred to as the District) and Kerx County, Texas, acting by and through its Commissioners' Court, have entered into the following agreement: PURPOSE The parties to this agreement, acting pursuant to the authority of Article 4413(32c), Revised Civil Statutes, known as the Interlocal Cooperation Act, have agreed that Kerr County will provide office space for the District's operation within the office area of the Kerr County Tax Assessor-Collector's office in the Kerr County Tax Office, together with certain other additional services to be provided by the Kerr County Commissioners' Court and certain County officials, including custodial services for the District's current operating funds, the operation of the District's payroll functions, and the payment of the District's routine operational bills in the same manner and subject to the procedures as are employed by Kerr County in performing these functions within its own operations. ~V TERM This contract shall, upon its ratification by both parties, become effective as of January 1, 1983, and shall be automatically extended for successive periods of twelve (12) i~~ months each unless terminated by either party by July 1 of the year preceding the end of the then current twelve months period of its being in effect. Should this contract be terminated,"', the parties agree that all capital equipment furnishings and facilities supplied by Kerr County shall remain the property of Kerr County. COSTS OF OPERATION Kerr County agrees to continue to furnish the office space previously furnished the District within the office area of the Kerr County Tax Assessor-Collector under a prior contract and to do so at no cost other than a monthly lump sum charge o- $100.00 to defray portions of utilities and building maintenance costs. Kerr County agrees to continue to provide all furnishings and equipment required by the Appraisal District office except vehicles, and to assess a rental charge of 12 z% annually of the original cost of furnishing and equipment purchased for the purposes of carrying out the obligations of this contract. When such furnishings or equipment have been fully amortized, under this and prior con- tracts, no furhter rental charge shall be assessed on it. Computer charges generated as a result of this contract, including one half of the monthly lease of the computer terminal, shall be charged to the District. PAYROLL AND FISCAL PROCEDURES Funds collected by the District to defray the costs of services to be rendered under the terms of this contract by the County shall be initially received by the District for deposit in its depository bank and the District shall, on a quarterly basis, make payment to the County of the budgeted quarterly operating costs of the appraisal office maintained by the Chief Appraiser of the District, which funds shall be deposited in the County's depository bank. These funds shall be maintained in a separate account for the maintenance and administration of the appraisal office. The disbursement of the funds so deposited with the Kerr County Treasurer shall continue to be in accordance with the provisions of Kerr County Commissioners' Court Order ~k14122 entered on the 8th day of September, 1980, which order shall remain in force and effect for all purposes, and which is incorporated into the provisions of this agreement and is appended hereto as "Exhibit A". There shall be no addi- tional charges made to the District by Kerr County for these services. Kerr County agrees i to provide these services at no cost, doing so in the interest of minimizing the cost of the District's operation, which costs must be borne by all the taxpayers of Kerr County and its '., various political subdivisions. OF KERR COUNTY On this the 8th day of September, 1980, came on to be heard and considered by the Court the matter of the creation of a separate fund in the depository bank of Kerr County by the County Treasurer for the purpose of receiving funds paid over to Kerr County by the Kerr County Tax Appraisal Board for the purpose of defraying the costs of contractual services rendered by Kerr County relative to the operation of a Countywide Tax Appraisal Office, and in addition thereto the matter of establishing policies and procedures relative to the dis- bursement of funds for this purpose; and it is accordingly ordered as follows: 1. There shall be created on the books of the Treasurer of Kerr County a separate account to be designated as the Tax Appraisal Office Fund. 2. All payments received by Kerr County from the Kerr County Tax Appraisal District or otherwise for the purpose of defraying the costs of contractual services rendered by Kerr County in the operation of the Countywide Tax Appraisal Office shall be deposited into the said account. 3. All personnel employed for the operation of the Tax Appraisal Office shall be deemed to be employees of Kerr County for payroll purposes and all other related purposes. 4. Payments for all other related costs and expenses incidental to the operation of the Tax Appraisal Office shall be subject to administrative approval and authorization by the County Auditor and the Commissioners' Court of Kerr County in the same manner as applies to the expenditures of other funds of Kerr County, subject to appropriate direction and budgetary authorization of the Kerr County Tax Appraisal Board. 5. A. While the actual rate of compensation to be paid the Chief Appraiser shall be fixed by the Tax Appraisal Board and the compensation to be paid other appraisal officer personnel shall be fixed by the Chief Appraiser within budgetary authorization, actual pay- ments of salaries and allowances shall be paid to all Tax Appraisal Office personnel on a monthly basis pursuant to appropriate administrative orders of the Kerr County Commissioners' Court with payments to be through the Kerr County payroll Fund from funds drawn from the Tax Appraisal Office Fund. B. Monthly employee contributions for FICA and County Retirement Benefit participa- tion together with other applicable withholdings shall be regularly withheld by the County Treasurer as in the case of other County employees. C. Employer contributions for the FICA, retirement contributions, hospitalization and similar purposes shall be paid monthly by the County Treasurer out of the Tax Appraisal Office Fund, either directly or through the payroll fund, whichever is administratively appropriate. D. Commencing with the month of January, 1981 and until otherwise ordered, the County Treasurer shall make monthly payments from the Tax Appraisal Office Fund into the General Fund of Kerr County as reimbursement for building maintenance and utilities as per contractual agreement. E. All other changes and expenses generated by the operation of the said Tax Appraisal Office shall be paid by the Kerr County Commissioners' Court out of the Tax Appraisal Office Fund as in the case of the payment of other County bills, normally at each regular monthly term of said Commissioners' Court and subject to the prior approval by the Chief Appraiser and the County Auditor. F. Funds on deposit in the Tax Appraisal Office Fund not immediately required for current operational expenses may, at the discretion of the County Treasurer and with the approval of the County Judge, be invested in interest bearing Certificates of Deposit in the County Depository of Kerr County as in the case of other County funds, and all interest so f~51 earned shall be credited to the said Tax Appraisal Office Fund.
