SHERRY SPEARS AND THE COUNTY OF KERR, TEYAS On this the 12th day of December 1983, upon motion made by Commissioner Holland seconded by Commissioner Higgins , the Court unanimously approved acceptance of a Perpetual Right- of-Way Easement between Mrs. SY:~erry Spears and the County of Kerr, Texas. It is further ordered that County Judge Gordon S. Morriss be authorized to execute the right-of-way easement on behalf of Kerr County, Texas. ~ ~ ~ ,. .~..,.~ ... _.. .,w _:. ~..... ,.< ~. ...:. .... ate:, ~ ,._.. _ STATE OF TEXAS ~ KNOW ALL MEN BY THESE PRESENTS: COUNTY OF KERR § THAT I, Mrs. Sherry Spears, of the County of Kerr, State of Texas, (herein Grantor} for and in consideration of the sum of ONE AND NO/100THS ($1.00) DOLLAR in hand paid by the COUNTY OF KERR, TEXAS, the receipt of which is here acknowledged, and the further consideration of the covenants later expressed herein, have this day GRANTED AND CONVEYED, and by these presents do GRANT AND CONVEY unto the COUNTY OF KERB, TEXAS (herein Grantee) an easement and public right-of-way upon and across all of the following described property: Being a portion of Tracts 17 and 18 of the JACK HALL SUBDIVISION, Kerr County, Texas, an easement designed to straighten a curve in Scenic Hills Road North of State Highway 16, consisting of 2,500 square feet, more or less, and described as a triangle with apex being a point touching the south side of Scenic Hills Road, and extending in an easterly direction along Scenic Hills Road to a point which is the boundary of Tracts 18 and 17, then proceeding in a northwestern direction 300 feet, more or less, to a second point touching the south side of Scenic Hills Road, then proceeding in a southeastern direction along Scenic Hills Road to the point of origin. The maximum distance between the apex and base of the triangle is 15 feet. In addition, a temporary license given to Kerr County for the storage of materials in excess of those needed for the construction of the Scenic Hills Road easement, as above described, is given. Such easement, above, is further described by reference to a copy of the plat herein attached. The easement will be further defined as actually situated and in use on the property. Included with this grant, without limitation, is Grantee's right to use the aforementioned right-of-way easement for the purpose of placing, constructing, operating, repairing, maintaining, rebuilding, replacing, relocating, and removing electric transmission lines, telecommunication transmission or distribution lines, placing, constructing, operating, repairing, maintaining, rebuilding, replacing, relocating, and removing a pipeline or water distribution line or sewer line or underground utilities for the transmission of natural gas products, or water or sewer providing pedestrian and vehicular ingress and egress over, across and upon the above described property. The foregoing agreements are, and shall remain, covenants running with the grant and the lands adjoining the same, and shall be binding upon and inure to the benefit of the parties hereto and the heirs, successors and assigns of the parties. The easement, rights, and privileges herein granted shall be exclusive and perpetual. Grantor hereby binds himself, his heirs, executors and administrators to WARRANT AND FOREVER DEFEND the above described easement and rights unto the said Grantee, its successors and assigns, against every person whomsoever lawfully claiming or to claim the same or any part thereof.
