ORDER N0. 15270 APPROVAL OF ACCEPTANCE OF PERPETUAL RIGHT-OF-WAY EASEMENT BETWEEN JAMES L, ARNOLD AND THE COUNTY OF KERR, TEXAS On this the 12th day of December 1983, upon motion made by Commissioner Higgins, seconded by Commissioner Guthrie, the Court unanimously approved a Perpetual Right-of-Way Easement between James L. Arnold and the County of Kerr, Texas. It is further ordered that County Judge Gordon S. Morris be authorized to execute the right-of-way easement on behalf of Kerr County, Texas. AP,NOLD, of the County of Kerr, and State of Texas, (herein Grantor) for and in consideration of the sum of CNE AND NO/100THS ($1.00) DOLLAR in hand ~~aid by the COUNTY OF KEF.R, TEXAS, the receipt of which is here acknowledged, and the further consideration of the covenants later expressed herein, have this day GRANTED AND CONVEYED, and by these presents do GRANT AND COr7VEY unto the COUNTY OF KERB, TEXAS (herein Grantee) an easement and public right-of-way upon and across all of the following described property of Grantor, viz: Being 10.16 acres of land, more or less, situated in Kerr County, Texas, approximately South 50° East 9 miles from Kerrville, the County Seat, being out of the John Goodbread Survey No. 38, Abstract No. 150, and being that property conveyed to James L. Arnold from Gordon W. Moore, et ux by Assumption Deed dated July 14, 1978, recorded in Volume 211, at Page 199 of the Deed Records of Kerr County, Texas, being more particularly described by metes and bounds as follows: BEGINNING at a point in the West line of the said John Goodbread Survey S. 00° 31' W. 8295.74 feet from the northwest corner of the said John Goodbread Survey; THENCE E. 1244.6 feet to a corner; THENCE S. 355.59 feet to a corner; THENCE W. 1246.1 feet to a corner; THENCE North along the West line of said John Goodbread Survey 355.59 feet to the PLACE OF BEGINNING, less a 35 foot strip off the West side of this tract for a road easement. SAVE AND EXCEPT that 5.08 acres of land, more or less, situated in Kerr County, Texas, approximately S. 50° E. 9 miles from Kerrville, the County Seat, being out of the John Goodbread Survey No. 38, Abstract No. 150, being more particularly described by metes and bounds as follows: BEGINNING at a point in the West Iine of the said John Goodbread Survey S. 00° 31' W. 8473.535 feet from the Northwest corner of the said John Goodbread Survey for the Northwest corner of the said 5.08 acre tract of land; THENCE West approximately 1246.1 feet to a corner for the Southwest corner of the said 5.08 acre tract of land; THENCE North along the West line of said John Goodbread Survey approximately 177.795 feet to the PLACE OF BEGINNING, less a 35 foot strip off of the West side of the said 5.08 acre tract of land being the identical property conveyed by Alexander Johnson. to Jim Forgy, et ux, by Deed dated March 17, 1975, recorded in Volume 175, Page 435 of the Deed Records of Kerr County, Texas. The description of the easement hereby conveyed is described as follows: Being a fifteen foot strip of land running along the entire northern boundary of the above Arnold tract, beginning with the northeast corner of said tract, which is contingent to the northwest corner of the Rossi tract and the southwest corner of the Williams tract, and then extending West approximately 1244.1 feet to the Northwest corner of the said Arnold tract and intersecting with said 35 foot easement which runs from the Southwest corner of the said Arnold tract to the Northwest corner of said tract. Included with this grant, without limitation, is Grantee's right to use the aforementioned right-of-way easement for the purpose of placing, constructing, operating, repairing, maintaining, rebuilding, replacing, relocating, and removing electric trans- mission lines, telecommunication transmission or distribution lines, placing, constructing, operating, repairing, maintaining, rebuilding, replacing, relocating, and removing a pipeline or water distribution line or sewer line or underground utilities for the transmission of natural gas products, or water or sewer providing pedestrian and vehicular ingress and egress over, across and upon the above described property. Grantee shall have the right to cut and trim trees or shrubery which may encroach upon the easemE~nt area herein conveyed and Grantee shall dispose of all cuttings and trimmings either by piling or burning within the easement arE~a or by loading and hauling away from the premises.
