Deloris Posey Mrs. Janet Smith Gerald Witt Lucille Edens o-o-o-o-o-o-o-o-o N0. 14894 RESOLUTION RELATING TO APPROVAL OF FINANCING OF COP4DIERCIAL PROJECTS; AND CONTAINING OTHER PROVISIONS RELATING TO THE SUBJECT WHEREAS, Kerr County (the "Unit"), a political su'odivision of the State of Texas, has !~ i approved and authorized the creation of the Kerr County Industrial Development Corporation (the "Corporation") as a Texas non-profit corporation, pursuant to the provisions of the Development Corporation Act of 1979, Article 5190.b, Vernon's Annotated Texas Civil Statutes, i as amended (the "Act"), to act on behalf of the Unit to promote and develop industrial and manufacturing enterprises to promote and encourage employment and the public welfare; and 6~1'dEREAS, the Corporation is authorized by the Act to issue bonds on behalf of the Unit to finance all or a part of the costs of a 'project' as defined i.n the Act; WHEF.EAS, the Unit has been designated by the Economic Development Administration, a federal agency, as an economically distressed county. WHEREAS, the population of the Unit is less than 50,000 according to the 1980 federal decennial census; and WHEREAS, the Act provides that, in a federally designated economically distressed county of less than 50,000 persons according to the last federal decennial census, a project may include the land, buildings, equipment, facilities and improvements (one or more) found by the board of directcrs of the Corporation to be required or suitable for the promotion of commercial development and expansion and in furtherance of the public purposes of the Act, or for use by commercial enterprises, all as defined in the rules of the Texas Industrial ~,,, Commission (the "Commnission"); and WHEREAS, the commissioner's court (the "Governing Body") of the Unit desires to request the Commmission to approve projects for commercial uses and in furtherance of such desire has concluded to adopt this resolution; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSIONER'S COURT OF KERR COUNTY, TEXAS, THAT: Section 1: Attached to this resolution as Exhibit A is a map showing the boundaries of the Unit outlined in red. (P4ap on file with Resolution) Section 2: The overall objectives of the Unit for redevelopment of the Unit are as follows: A) To promote the present and prospective health, safety, right to gainful em- ployment and general welfare of the people of Kerr County and the state. B) To promote the continued existence, development and expansion of commerce and industry, essential to the economic growth of the county and the full employment, welfare and prosperity of its citizens; C) To promote and accelerate the economic development of Kerr County. Section 3: The Governing Body of the Unit hereby finds and represents to the Com- mission that the availability of financing of projects, as further defined in Section 4 of this resolution, for commercial uses under the Act will contribute significantly to the alleviation of the economically depressing conditions found to exist in the Unit. Section 4: The Governing Body of the Unit, in order to enhance its development efforts,', desires and authorizes all commercial projects that are an integral part of the local economy, including but not limited to industries which promote energy, tourism, transporta- tion, trade (including retail establishments), and the general commerce of the county. The commercial projects must contribute to the economic growth or stability of the County by; a) increasing or stabilizing employment opportunities; b) increasing or stabilizing the property tax base; or c) promoting commerce within the county and the state, This section shall be liberally constructed in conformity with the intentions of the Texas legislature as expressed in the Development Corporation Act of 1979, as amended, as well as the rules issued by the Commission. Section 5: The Governing Body of the Unit will review all project descriptions sub- mitted to the Unit pursuant to this resolution for approval of specific projects for cocmner- cial uses within the Unit in order to determine whether such projects are consistent with the Unit's objectives as set out in this Resolution for alleviation of the economically depressed condition of the Unit. Section 6: The Unit will continue to develop public improvements, to be made within the county, on an individual project basis in areas where the County seeks to encourage the development of commercial projects. Section 7: This Resolution is adopted for the purposes of satisfying the conditions and requirements of the Act and the Rules, and for the benefit of the Corporation, the Unit, the Commission and all other interested persons. Section 8: The Governing Body has considered evidence of the posting of notice of this meeting and officially finds, determined, recites and declares that a sufficient written notice of the date, hour and place of this meeting and of the subject of this Resolution was posted on a bulletin board at a place convenient to the public in the County Courthouse of the Unit, for at least 72 hours preceding the scheduled time of such meeting; such place of posting was readily accessible to the general public at all times from such time of posting until the scheduled time of such meeting; and such meeting was open to the public as required by law at all times during which this Resolution and the subject matter thereof were dis- cussed, considered and formally acted upon, all as required by the Open Meetings Law, Article 6252-17, Vernon's Annotated Texas Civil Statutes, as amended. A. Fawcett, III and Tim R. Cowden February 12th, 19th and 26th, 1983 March 12th, 19th and 26th, 1983 April 9th and 17th, 1983 May 1st and 15th, 1983 (at a charge of $200.00 per day) International Brangus Breeders Association June 6th thru 11th, 1983 (at a charge of $200.00 per day) Hill Country District Junior Livestock Association July 29th thru July 31st, 1983 Proceeds will go to the Hill Country District Junior Livestock Association.
