THREE On this the 12th day of December 1983, upon motion made by Commissioner Lich, seconded by Commissioner Holland, the Court unanimously approved acceptance of the bid of Archie Koennecke, for one 1964 Chevrolet Dump Truck in Commissioner's Precinct No. Three, in the ~.. amount of $2,156.00, as the highest and best bid submitted. o-o-o-o-o-o-o-o-o-o N0. 15267 APPROVAL OF CLAIMS AND ACCOUNTS On this the 12th day of December 1983, came on to be considered by the Court, the various claims and accounts against Kerr County and the various Commissioners' Precincts, since the last term of Court, which claims and accounts were approved for payment by the Auditor and Treasurer, in amounts and out of Road & Bridge No. 1, 2, 3 and 4, General, Lateral Road 2, Juvenile Probation, Juvenile State Aid, Revenue Sharing Trust, Jury, County Law Library, Public Library, 216th District Probation, Juvenile Services, Traffic Safety Funds Motion made by Commissioner Holland, seconded by Commissioner Higgins and unanimously approved by the Court. o-o-o-o-o-o-o-o-o-o N0. 15268 APPROVAL OF ACCEPTANCE OF PERPETUAL RIGHT-OF-WAY EASEMENT BETWEEN MRS. SHERRY SPEARS AND THE COUNTY OF KERR, TEXAS On this the 12th day of December 1983, upon motion made by Commissioner Holland, seconded by Commissioner Higgins, the Court unanimously approved acceptance of a Perpetual Right-of-Way Easement between Mrs. Sherry Spears and the County of Kerr, Texas. It is further ordered that County Judge Gordon S. Morriss be authorized to execute the right-of-way easement on behalf of Kerr County, Texas. STATE OF TEXAS X COUNTY OF KERR X PERPETUAL RIGHT-OF-WAY EASEMENT KNOW ALL MEN BY THESE PRESENTS: THAT I, Mrs. Sherry Spears, of the County of Kerr, State of Texas, (herein Grantor) for and in consideration of the sum of ONE AND NO/100THS ($1.00) DOLLAR in hand paid by the COUNTY OF KERR, TEXAS, the receipt of which is here acknowledged, and the further considera- tion of the covenants later expressed herein, have this day GRANTED AND CONVEYED, and by 'y these presents do GRANT AND CONVEY unto the COUNTY OF KERR, TEXAS (herein Grantee) an easement and public right-of-way upon and across all of the following described property: Being a portion of Tracts 17 and 18 of the JACK HALL SUBDIVISION, Kerr County, Texas, an easement designed to straighten a curve in Scenic Hi11s Road North of State Highway 16, ~' consisting of 2,500 square feet, more or less, and described as a triangle with apex being a point touching the south side of Scenic Hills Road, and extending in an easterly direction ''~ along Scenic Hills Road to a point which is the boundary of Tracts 18 and 17, then proceeding. in a northwestern direction 300 feet, more or less, to a second point touching the south side of Scenic Hills Road, then proceeding in a southeastern direction along Scenic Hills Road to the point of origin. The maximum distance between the apex and base of the triangle is 15 feet. In addition, a temporary license given to Kerr County for the storage of materials in excess of those needed for the construction of the Scenic Hills Road easement, as above described, is given. Such easement, above, is further described by reference to a copy of the plat herein attached. The easement will be further defined as actually situated and in use on the property. Included with this grant, without limitation, is Grantee's right to use the aforemention- ed right-of-way easement for the purpose of placing, constructing, operating, repairing, maintaining, rebuilding, replacing, relocating, and removing electric transmission lines, telecommunication transmission or distribution lines, placing, constructing, operating, repairing, maintaining, rebuilding, replacing, relocating, and removing a pipeline or water distribution line or sewer line or underground utilities for the transmission of natural gas products, or water or sewer providing pedestrian and vehicular ingress and egress over, across and upon the above described property. Grantee shall have the right to cut and trim trees or shrubery which may encroach upon the easement area herein conveyed and Grantee shall dispose of all cuttings and trimmings either by piling or burning within the easement area or by loading and hauling away from the premises. The foregoing agreements are, and shall remain, covenants running with the grant and the lands adjoining the same, and shall be binding upon and inure to the benefit of the ~(~( parties hereto and the heirs, successors and assigns of the parties. '°~~ ~ The easement, rights, and privileges herein granted shall be exclusive and perpetual. Grantor hereby binds himself, his heirs, executors and administrators to WARRANT AND FOREVER DEFEND the above described easement and rights unto the said Grantee, its successors it and assigns, against every person whomsoever lawfully claiming or to claim the same or any part thereof.
