Girard, and wife, Perry F. Girard, of the County of Kerr, and State of Texas, (herein Grantor) for and in consideration of the sum of ONE AND NO/100THS ($1.00) DOLLAR in hand paid by the COUNTY OF KERR, TEXAS, the receipt of which is here acknowledged, and the further consideration of the covenants later expressed herein, have this day GRANTED AND CONVEYED, and by these presents do GRANT AND CONVEY unto the COUNTY OF KERR, TEXAS (herein Grantee) an easement and public right-of-way upon and across all of the following described property in a warranty deed ~p1255 shown as parcel ~p2, recorded in Volume 154, page 842, of the Records of Kerr County: Being a portion of Tract 306-B in the L. A. Patillo survey No. 1139, an easement designed to widen and straighten Dingley View Road, consisting of 1,254.5 square feet, more or less, and described as a triangle with the apex being a point touching the current easement line which is the furthest northwest point of Tract 306-B, then proceeding along the easement line in a northeastern direction for 312 feet to the iron stake, then proceeding southwest to a point where the road easement lies, at a second iron stake, approximately 962 feet, then running along the easement in a northern direction 762 feet to the point of the triangle's apex, the point of origin. Such easement is further described by a copy of the plat herein attached. The easement will be further defined as actually situated and in use on the property. Included with this grant, without limitation, is Grantee's right to use the aforemention- ed right-of-way easement for the purpose of placing, constructing, operating, repairing, main- taining, rebuilding, replacing, relocating, and removing electric transmission lines, tele- communication transmission or distribution lines, placing, constructing, operating, repairing maintaining, rebuilding, replacing, relocating, and removing a pipeline or water distribution line or sewer line or underground utilities for the transmission of natural gas products, or water or sewer providing pedestrian and .ehicular ingress and egress over, across and upon the above described property. Grantee shall have the right to cut and trim trees or shrubbery which may encroach upon the easement area herein conveyed and Grantee shall dispose of all cuttings and trimmings either by piling or burning within the easement area or by loading and hauling away from the premises. The foregoing agreements are, and shall remain, covenants running with the grant and the lands adjoining the same, and shall be binding upon and inure to the benefit of the parties hereto and the heirs, successors and assigns of the parties. The easement, rights, and privileges herein granted shall be exclusive and perpetual.
