ORDER NO. 15037 ORDER AUTHORIZING LETTER TO DEPARTMENT OF HEALTH CONCERNING ROAD MAINTENANCE AS IT RELATES TO SOLID WASTE PERMIT On this the 9th day of May, 1983, came on to be considered by the Court the matter of proposed letter to be sent to the Texas Department of Health as recommended by the Landfill Development Committee at its meeting on April 22, 1983; and it appearing to the Court that the solid waste management regulations require a statement of road maintenance authority, and that the City of Kerrville will be taking parallel action at its meeting on May 10, 1983, it is ordered on motion by Commissioner Holland seconded by Commissioner T;rh and unanimously approved by the Court that the County Judge be authorized to forward a letter confirming that the access roads can safely accomodate additional traffic to be generated by the proposed solid waste disposal operation applied for through the Texas Department of Health. ~ 'r36.:'?~ Texas Robert Bernstein, M. Regional Director Over the past few years, the Texas Department of Health has seen a significant increase statewide in the occurrence of illegal or promiscuous solid waste dumping. As I am sure you are aware, Kerr County hoe seen its share of this problem along its rivers, highways, back roads and vacant properties. The problem appears to increase proportionately with the growth of property development and the c:::,~aty's expanding population. Our Region 9 Environmental Health staYfi in Uvalde is often hard pressed to respond immediately to complaints of illegal dumping in Kerr County. Distance and our twenty-one-county responsibilities often put restraints on travel agendas. We try to respond to complaints as soon as possible or as itineraries permit, but this often results in a site already constituting an extensive problem before we can get there to investigate it and start closure procedures. Conversely, a local Sani- tarian might quickly remedy the problem by makin~;,a more timely response. We are requesting your assistance in pursuing illegal dumping in Kerr County on a local basis. This might be readily implemented by the field representative of the Upper Guadalupe River Authority (UGRA) taking on the authority of solid waste disposal enforcement. Such reaponaibilitiea would hopefully be in accordance with existing legal authority conveyed to the UGRA Sanitariana as agents of the Kerr County Health Officer, T. M. Boyce, Jr., M.D. ,: Honorable Gordon Morriss Kerr County Judge April 20, 1983 Page 2 Heretofore we have requested that all solid waste disposal responsi- bility in Kerr County be deferred to the Texas Department of Health to ensure statewide enforcement continuity. While this continuity is still implicit and necessary, we see a pressing need to secure expanded local assistance in dealing with this growing problem. We feel confident that our longstanding cooperation will facilitate the effective abatement of illegal dumping in Kerr County. Please be assured that our office will afford its full cooperation whenever required. At the same time, we will maintain on-going surveillance and permitting oP municipal solid waste disposal sites in the county, such as the city of Kerrville's sanitary landfill or any other sites seeking or operating under the permit authority of the Texas Department of Health. Such surveillance activities can be regularly scheduled on an itinerant basis by our office here in Uvalde. In submitting this proposal for your consideration, we are aware of your presently er.,n,iding workload in wastewater surveillance and oP the highly ef4°ective results these efforts have brought about since the inception of your program. We feel certain that the same effective control oP illegal dumping might be obtained to the significant benefit of Kerr County, should you accept this new responsibility. Please let us know at your earliest convenience if these arrange- m~~nts can be consummated through the consideration of your Board of Directors and the Kerr County Commissioners Court.
