ORDER N0. 15148 ORDER AMENDING SECTION 36 C OF LEASE AGREEMENT FOR FIXED BASE OPERATOR, BETWEEN THE CITY OF KERRVILLE AND THE COUNTY OF KERR, TEXAS, LESSOR AND KX AVIATION, INC., BY JOHN MILLER, JR., PRESIDENT, LESSEE On this the 19th day of August 1983, upon motion made by Commissioner Higgins, seconded by Commissioner Holland, the Court unanimously approved that Section 36 C of Lease Agree- ment for Fixed Base Operator, between the City of Kerrville and the County of Kerr, Texas, Lessor and KX Aviation, Inc., by John Miller, Jr., President, Lessee, be amended, in that the total amount of $54,350.00 previously authorized by the City of Kerrville and the County of Kerr, be not used entire- ly for the taxiway, but that a portion of the amount be used for drainage improvement and a portion to be used for site preparation, subject to concurrence by the City of Kerrville. TV OF %lRRVILLE, TE%AS In making their recommendation, the Airport Board had the understanding with the FBO operator that the dirt removed from Tract 3 would be used to fill the large ditch adjacent to Tract 3, would also be used to form a berm around the fuel storage installation of FBO, and the balance and majority of the dirt would be stored near the future Runway 12-30 extension. We are attaching copies of the sketch, the previous letter to you of August 10 and the August 9 memo in regard to estimate, The reconsideration of this transfer of funds, which is covered in Section 36 (C) of the FBO Contract, is scheduled for con- sideration by the City Council at their meeting on August 23, 1983. What remains out of the $54,350 authorized, then is intended to be set aside for creation of the proposed taxiway-roadway site.
