Francis Survey No, 146, Abstract No. 137 (owned by K.I.S.D.)I and that part of Ranchero Road abutting said 0.24 acres (owned by Kerr County), ~' AGREEMENT BETWEEN KERR COUNTY AND KERRVILLE INDEPENDENT SGHOOL DISTRICT !I WHEREAS KERRVILLE INDEPENDENT SCHOOL DISTRICT (K.I,S.D.") owns 0,24 acres of land along Ranchero Road in Kerr County, Texas, out of William C. Francis Survey No. 146, Abstract No. 137, conveyed by Harry A, Claypool as part of a 10.00 acre tract, said conveyance recorde~ in Volume 246 at Page 152 of the Deed Records of Kerr County, Texas; and i WHEREAS KERR COUNTY ("KERR") owns that part of Ranchero Road abutting said 0.24 acres;anc~ WHEREAS KERR, through its County Commissioner's Court, desires to utilize said 0.24 acres to make safe a certain curve in Ranchero Road, thereby omitting a similar 0.24 acres ~! on the east side of Ranchero Road which no longer will be used for Ranchero Road; and WHEREAS K.I.S.D. desires to utilize the similar 0.24 acres to be omitted from Ranchero Road for parking or access to adjoining land, but by law KERR can only convey real estate ' after public auction for market value, which is not anticipated by KERR, IT IS THEREFORE AGREED that K.L.S.D. will by Warranty Deed convey the above described 0.24 acres to KERR which shall use it to rebuild Ranchero Road; in addition, a similar 0.24 acres, more or less, on the east side of Ranchero Road to be omitted from Ranchero Road as rebuilt, will be made available to K.I.S.D. for its use for parking or access to adjoining land so long as such usage is not inconsistent with KERR`s ownership, and that K.I,S.D. will not construct any permanent improvements that might be inconsistent with said ownership.
