REQUEST BY CITY OF KERRVILLE TO APPROVE PAYMENT BY
CITY IN AP40UNT OF $2,800.00 TO OLMOS EQUIPMENT CO.
ON AIRPORT RUNWAY REWORK
On this the 9th day of April 1984, upon motion made
by Commissioner Higgins seconded by Commissioner
Holland the Court unanimously approved the request
by the City of Kerrville to approve payment by the City
in the amount of $2,800.00 to Olmos Equipment Company,
for airport runway rework and overlay, as recommended
by Bruce Motheral, Engineer.

Dear Judge Morriss,
On January 24, 1984, the City Council approved final payment to
Olmos Equipment Company of San Antonio, Texas, in the amount of
$66,297.97 for airport runway rework and overlay. The original
invoice was for $69,505.22 with $207.25 being withheld for elec-
trical work performed by the City, and $3,000,00 liquidated
damages deducted from invoice for being ten (10) days late in
the completion of the project.

Since that time the contractor has furnished the City with docu-
mentation explaining why they were 9.3 days late in completing
the project (see Attachment A). After receiving this additional
information, the engineer on the project, Sruce Motheral, recom-
mends to pay Olmos Equipment another $2,800.00 (see Attachment
B).
At the City Council meeting on March 13, 1984, the Council voted
to pay the additional $2,800.00 pending parallel action by the
County. Therefore, the City respectfully requests that the County
Commissioners, at their next meeting, also approve payment of
$2,800.00 to Olmos Equipment Company. If you approve the addi-
tional payment, the City will pay the contractor, and bill the
County their portion as usual.

Dear Mfr. 01de,
tJe take exceptions to the letter from you dated 30 January
1984, where you informed us that the City Council opted to deduct
liquidated damages of $3,000.00 from our final payment for 10 days
at $300.00 per day.
It was my understanding with city personnal in the field that
we had no time problem because of the delingent way that we persued
the project. Your people and the FAA representative all said we
did an excellent job.
We would like to list the following reasons why we should not be
charged the 10 day of liquidated damages:
1. Excavation was estimated at 31,340 c.y. We moved
excavation of 39,980 c.y. an additional amount of
8,640 c.y. This item at 2,000 c.y. per day used up an
additional time of 4.3 days.
2. Rework base material rutted by Du Goush people involved 2 days,
3. We were also slowed down on a Project by the airplane
crash and the investigation that followed by one day.
4. We also had a Vasi wire not shown on our plans that we
had to replace that was added to our contract item
l~1-125-5.1 (F). It took one day for a decision on the
price to install this line. It took one day for delivery
of the wire and to install the wire and partial ditch.

If you review all the Eacts I think you will agree with me
that several items were beyond our complete control, and should have
been considered in the time used in this job.
Actual additional time loss: 9.3 days
Actual additional time deducted: 10 days
Please review this with your personnel and notify me of your
decision. I have enjoyed caorking with the City and you once
aor,tn, and I am sure any decision you and the City reach will be
fair and just.
