ORDER N0, 15485 ORDER GRANTING REQUEST FOR RETURN OF EXECUTED EASEMENT FROM MOONEY AIRCRAFT CORPORATION TO STATE OF TEXAS On this the 14th day of May, 1984, the Court considered a request from Steve Ables, Attorney for Mooney Aircraft Corporation, for the return of an unrecorded easement, executed by officials of Mooney Aircraft Corporation in November, 1982, such easement having been executed as a good faith agreement with Kerr County that it would be held until such time as other easements were acquired for the purpose of right of way acquisition for the construction of Spur 535, also to be known as "Airport Loop"; said request being made due to the fact that efforts to secure all ease- ments required have failed, and due to passage of time without success of the completion of the project, Mooney Aircraft Corporation deemed it in their best interest to pursue other uses of the property involved; The Court, by a majority vote, approved a motion made by Commissioner Guthrie, seconded by Commissioner Higgins, with Commissioners Holland and Lich voting "No", and Judge Morriss, Commissioners Higgins and Guthrie voting "yes", that Kerr County hand deliver to Attorney Steve Ables, representing Mooney Aircraft Corporation, the unrecorded easement executed by officials of Mooney Aircraft, and that Mooney Aircraft be released from terms of the agreement with Kerr County and the State of Texas for such easement intended for Spur 535 right of way requirements.
