ORDER NO. 16232 APPROVAL OF AGREEMENT BETWEEN KERR COUNTY, TEXAS AND THE STATE OF TEXAS - RE: CONSTRUCTTON OF CONCRETE CURB AND INCIDENTAL ITEMS [~dITHIN THE LIMITS FROM STATE HIGHWAY NO. 16 SOUTH OF KERRVILLE TO SOUTHEAST APPROXIMATELY 2 MILES ON LOOP 534 On this the 12th day of August 1985, upon motion made by Commissioner Higgins, seconded by Commissioner Guthrie, with Commissioners Hiqqins, Lich and Guthrie and County Judge Morriss voting "AYE" and Commissioner Holland "ABSTAINING FROM VOTING", said motion carrying by a majority vote, approving an Agreement, made the 12th day of August, 1985, by and between Kerr County, Texas, acting by and through its Commissioners' Court, and the State of Texas, acting by and through its State Highway and Public Transportation Commission. Said contract provides for County funding for curbing and incidental items for approximately two miles of Loob 534, beginning from State Highway 16 South at the County's expense in an amount of $8,900.00. Such property is to be annexed by the City of Kerrville on or about October 20, 1985, but immediate funding was requested, due to the scheduling of the proiect by the State. Louis Odle City Dlanager Kerrville City Hall 800 Junction Highway Kerrville, Texas 78028 RE: Curbing along Loop 534 Dear Lou: Yesterday at commissioners' court, Mr. Bill Tucker of the Texas Highway Department asked the Court to advance funds for curbing along the loop in an area annexed by the City of Kerrville, which annexation will take place on or about October 20, 1985. A copy of his letter and agreement are attached. (512) 257-6711 The Court was reluctant to advance the funds for the project, but was told by Mr. Tucker that as the County presently had jurisfliction over that part of the loop, and that inaction by the County would jeopardize funding of the entire project. Funding was ordered by the Court, which directed me to request reimbursement by the City of Kerrville of the $8,900.00 paid. Please consider this a formal request for reimbursement. We would appreciate you bringing this matter before the city council for action at your next meeting. Sincerely, Bill Baskette, Jr. ~ ~~~.. . _,_,...... ~I Kerr County STATE OF TEXAS COUNTY OF TRAVIS THIS AGREEMENT, made this day of 1985, by and between Kerr County, Texas, hereinafter called the "County", Party of the First Part, acting by and through its Commissioners Court and the State of Texas, hereinafter called the "State", Party of the Second Part, acting by and through its State Highway and Public Transportation Conmiission. WHEREAS, the County desires the construction of concrete curb and incidental items within the limits from State Highway No. 16 South of Kerrville to Southeast approximately 2 miles on Loop 53A, which is solely the County's responsibility and the County has requested the State to construct or have constructed this work. The State will construct or have constructed this work for and on behalf of the County and at the County's sole expense, excludingpreliminary engineering. The estimated construction cost of this work is Eight Thousand Nine Hundred and No/100 Dollars ($8,900.00), including contingencies and construction engineering. NOW THEREFORE, it is understood that this proposed work will be constructed by the State and the County will transmit to the State with the return of this agreement, executed by the County, a warrant or check made payable to the State Department of Highways and Public Transportation in the amount of Eight Thousand Nine Hundred and No/100 Dollars ($8,900.00), to be used in paying for the proposed work required by the County. It is further understood that the State will construct only those items for the County as requested and required by the County and the entire cost of such items, excluding preliminary engineering, will be borne by the County. If the State elects to receive bids and if upon receipt of bids by the State and/or the actual construction and/or approved changes in the contemplated improvements, it is found that this amount is insufficient to Ray the County's portion, then the County upon request of the State will forthwith supplement this amount by an amount equal to the County's full estimated or actual share of the cost of this work less the amount previously paid to the State Department of Highways and Public Transportation. In the event the amount as paid is more than the actual cost, then the excess amount will be returned to the County. It is further understood that the work to be done on behalf of the County, as herein provided, will include the cost of contingencies and co-•,;;truction engineering.
