Coaats ~ 1 0! 2 Pas« DLtrlct No. ~~.._. 15 . g _. ,' WHEREAS, in KERR COUNTY on LOOP 534, frao State Highway 16 South of Kerrville, Southeast to arm to arket o~ad-b'$g, a distance of approximately 2.0 miles, the State Department of Highways and Public Transportation is preparing plans for reconstruction; and WHEREAS. the City of Kerrville and Kerr County x111 have responsibilities in the pro- 3ect; NOW, THEREFORE, the Engineer-Director is directed to tender the following proposal to the City of Kerrville and Kerr County: Provided the City and/or County will: 1. Provide for the construction of continuous curb and gutter where none now exist, storm sewers, etc.. aTT as may be necessary for a complete project with the exception of pavement and its support. 2. Maintain that portion of the work which is Its responsibility in accordance with present aaintenance agreemenLS, and agree to regulate traffic and pre- vent encroachment on the rfght of way, ail in accordance with governing ' policies and regulations of the Department. The State Department of Ntghxays and Public Transportation wi11: 1. Provide for reconstruction at an estimated cost of E910,000. 2. Maintain that portion of the work which is its responsibility 1n accordance with present maintenance agreement. - - ~~' MINUTE ORDER '~` ~ °' 2 'y~ ,,.uut Ne. 15 Upon acceptance of the provisions of this Order by the appropriate officials of the City of Kerrville and Kerr County, the Engineer-Director is directed to proceed with development of plans for construction and after the City and/or County have fulfilled their responsibilities, proceed with construction 1n the most feasible and economical manner, financing the cost in the 1984 District Discretionary Construction Program. It is understood that the City and/or County may discharge their construction obliga- tions as outlined herein in any manner as they may elect. In the event the City and/or County desires the State to include their portion of work in the State's construction contract, the Engineer-Director is hereby authorized to enter into agreement with the City and/or County for such cork and its cost as may be agreed upon. This Order shall become operative upon acceptance by the City of Kerrville and Kerr County and if not accepted within 90 days of the date hereof. the action herein con- tained shall be automatically cancelled. This Minute Order states that the County will provide for the construction of "continuous curb and gutter where none now exist, storm sewers, etc." However, this project will not require concrete gutter or storm sewer. Continuous curb is all that the County will have to fund.
