OFFICE OF JUSTICE OF THE PEACE PRECINCT No. 1 March 23, 1975 KERB COUNTY COURTHOUSE KERRVILL E, TEXAS 78028 512.257-7467 SUBJECT: Monthly Report of Collections Criminal Cases T0: Justices of the Peace Precincts 2, 4 and 5 The Commissioner's Court of Kerr County, Texas at their regularly monthly meeting on March 10, 1975 informally approved a procedural change in the reporting of collections by Justices of the Peace in all criminal cases. Since both the County Attor- ney and the Sheriff are now salaried and not dependent upon commissions there is no longer a requirement to show on the re- port the 10°fo allocation of fines to the County Attorney and the 5/ allocation of the fines to the Sheriff. I have discussed this new reporting procedue with James Watts of the auditing Prim of Pressler and Thompson. Between us we have arrived at a new reporting format to be used by all Justices within Kerr County. Enclosed are copies of two reporting forms and the follow- ing is an explanation of those cases shown thereon which are the normal cases that we encounter: Cause #100 - Defendant was ticketed by the Highway Patrol, Pleaded guilty, paid a fine of $25.00 and costs of $2.50 for the Criminal Justice Planning Fund. REMEMBER no arrest fee is charged in Highway Patrol cases. Cause #101 - Defendant posted an Appearance Bond on a High- way Patrol ticket, failed to appear and her bond was forfeited in liew of the fine and costs. Cause #102 - Defendant was ticketed by a Deputy Sheriff, Plaeded guilty and paid fine and costa. REMEMBER when a member of the Sheriff's Depart- ment issues a ticket an arrest fee of $3.00 should be charged. Cause #103 - Defendant was ticketed by the Highway Patrol, Pleaded Not Guilty, demanded a Jury Trial, was found guilty by the jury which asaeesed a fine and coats. OFFICE OF JUSTICE OF THE PEACE PRECINCT No. 1 K ERR COUNTY COURTHOUSE KERRVIL LE, TE%AS 78028 Page -2- CAUSE #104 - Defendant was arrested by Sheriff's Depart- ment, was tried and found guilty, assessed a fine of $25.00 and $5.50 costs but not having any money was committed to jail in lieu of payment. If more than one page is needed then use as many pages as you require and put the Recapitulation on the last page of the report. 514 -257.7467 I have also discussed this new reporting with Ed Walker, Game Warden, and he advises that he would appreciate putting all Parks and Wildlife cases on a separate page and that we make an extra copy of that report for his files. I have, therefore, included a format for reporting those cases and the following is an explanation of those cases showns Cause #105 - Defendant pleaded guilty to a fairly serious violation and paid his fine and costs. Cause #106 - Defendant upon hearing was found guilty and paid her fine and costs. Cause #107 - Defendant requested a jury trial, was found guilty and the jury assessed the fine and costs which were paid. Cause #108 - Defendant plead guilty and was assessed fine and costs but not having any money he was committed to jail and served his time. REMEMBER that in all Parks and Wildlife cases the Depart- ment is enetiled to an arrest fee of $3.00 and 85°~ of the fines collected. The County receives all jury fees, 15~ of the the fines collected and the $2.50 for the Criminal Justice Planning Fund. You DO NOT issue a separate check to the County for the Parks and Wildlife offenses but you DO INCLUDE it in the check w th the other criminal cases. ~~~ ames J.
