ORDER NO. 16001 RESOLUTION OF THE COMP4ISSIONERS COURT OF KERR COUNTY T E X A S THE STATE OF TEXAS X X KNOW ALL MEN BY THESE PRESENTS: COUNTY OF KERR X WHEREAS, this Court, having reviewed House Bill 191 and its companion bill, Senate Bill 539, Senate Bill 321 and Senate Bill 331, all dealing wholly or in part with fees collected by the District Clerks of Texas, and having reviewed a current survey which reflects that most district clerks, including the District Clerk of Kerr County, are experiencing serious deficits in their offices, respect- fully urges the members of the Texas State Legislature and the Governor of this State to exercise every effort within reason toward PASSAGE AND ENACTMENT INTO LAW OF HOUSE BILL 191 AND SENATE BILL 539, the result of which will reduce the losses sustained by counties in Texas through the operation of their District Clerks` offices. AND WHEREAS, this Court further goes on record by and through this Resolution, as STRONGLY OBJECTING to the consideration of any legislation purporting to increase the filing fees of District Clerks, but which by said increase provides absolutely no assistance to the continually increasing deficits experienced in the operation District Clerks' offices. Higgins °~i. ~ n u~~irie, #4 House Bill 191 and Senate Bill 539 - This is a fee bill that would raise the District Clerks' fees almost double, but all fees would stay with the County, except in Criminal Cases where we are already sending parts of Criminal Court Cost to the State, but all Civi] fees would stay in Kerr County. This is the bill that all the District Clerks are recommending and urging passage by the Legislature. Senate Bill 321 - This bill would increase the district clerks filing fee to $100.00. 75°s of all fees collected would be returned to the state comptroller to be deposited into the State's General Fund. Senate Bill 331 - This bill would increase the cost of filing a new petition from $25.00 to $65.00. The $40.00 increase would be returned to the Sate to fund the District Court Judges Supplemental Salary & Judicial System Support Fund. House Bill 1308 - Again, a $40.00 increase would be added to the clerks filing fee with the increase returned to the State to fund the District Court Supplemental Salary & Judicial Support Fund. House Bill 2051 - In this one the filing fee i5 increased to $100.00. The ENTIRE $100.00 FILING FEE would be returned to the State to fund the JUDICIAL CAMPAIGN FUND.
