Schreiner, III, for an official court finding that the division of 8400 acres, more or less out of the Y. 0. Ranch in Kerr County, Texas, said 8400 acres, more or less, being comprised of two tracts of land, being 5372 acres, more or less, out of the west portion of the Y 0 Ranch and 3030 acres, more or less, out of the south- east portion of the Y O Ranch, into smaller tracts of land, as depicted on the attached two plats, for the purpose of resale is for agricultural purposes and falls within the exemption stated in Section 3.16 of the Kerr County Subdivision Rules and Regulations. Schreiner, III, contemplates selling 8,000 to 9,000 acres of land in several parcels, all of which land comprising part of the Y-O Ranch in Kerr County, Texas. For your information, attached are surveys of the properties contemplated to be sold by my client at this time. An interpretation of Kerr County Subdivision Rules and Regula- tions defines my client's contemplated action as subdivision; conse- quently, this letter is offered as Chas. Schreiner, III's request for an official court finding that such action as herein above-described, is not a subdivision within the meaning of same as defined by Kerr County Subdivision Rules and Regulations in as much as such division of property and subsequent sales are for agricultral purposes. The facts surrounding the proposed conveyances are as follows: 1) All tracts of land which my client contemplates selling at this time, would be large acreage tracts of land with the smallest possible portion being not less than 150 acres. It is my client's desire to sell as few tracts of land as possible, however at this time that information is not ascertainable in that buyers are not on hand. 2) All tracts sold by my client will be sold for agricultural purposes from my client's point of view. 3) The portion of property on the west side of the Y-O Ranch would require no roads in as much as all tracts sold will border State Highway 83. Reviewing this request, if the court desires further information or to visit with my clients, please advise. If not, please grant your order interpreting the action as herein stated as not constituting Goober 8 , 1985 Commissioners Court of Kerr County, Texas Page 2 a subdivision as per the Kerr County Subdivision Rules and Regulations.
