On this the 11th day of August 1936, upon motion made by
Commissioner Holland, seconded by Commissioner Higgins,
with Commissioners Holland, Higgins, and Guthrie and
County Judge Morriss voting "AYE" and Commissioner Lich
voting "NAY", said motion carrying by a majority vote
approving the City/County Airport Ldater System Agreement,
between the City of I:errville, herein called "City", and
the County of I:err, herein called "County".
It is ordered by the Court that County Judge I4orriss be
authorized to execute the Agreement on behalf of I:err
County.
CITY/COUNTY AIRPORT WATER SYSTEM A^vREEMENT
This City/County Airport Water System Agreement made
this day by and between the City of Kerrville herein called
"City" and County of Kerr herein called "County" as follows:
1. This contract pertains to and covers what is known as
the Airport Water System. It consists of a. water well, a
storage tank, pumps, motors, water mains and service lines.
The Airport Water System is now owned jointly between the
City and County. The Airport Water System is now
independent of the City of Kerrville Water System, but it
may in the future be incorporated into the central City
water system.
2. The County hereby conveys all of its interest in all
properties, tangible and intangible (including easements) of
the Airport Water System to the City.
3. City shall assume the sole maintenance and operation of
the Airport Water System. The City shall be entitled to
100 of all revenue derived from the system.
4. The City shall provide water service for future growth
at the Airport for joint City/County Airport purposes and
for joint City/County tenants as may be reasonable and
necessary.
5. The cost of future mains, service lines, and related
work, as may be necessary to serve new customers, shall be
paid 1/2 by City and lf2 by County.
6. Unless provided otherwise herein, it is the intent of
this agreement that in the future, the relationship between
the City/County, and the custom and practices applicable
thereto, will be the same as the same exist between the City
and land owner - developers inside the City.
