APPROVAL OF AGREEMENT BETWEEN KERR COUNTY AND
CLARK & STROMAN CONSTRUCTION, INC., FOR CONSTRUCTION
OF A JUVENILE DETENTION CENTER ON THE THIRD FLOOR OF
THE KERR COUNTY COUR'PHOUSE
On this the 24th day of July 1986, upon motion made by
Commissioner Holland, seconded by Commissioner Higgins,
the Court unanimously approved an Agreement for construc-
tion of a Juvenile Detention Center on the third floor of
the Kerr County Courthouse (alterations and renovation, etc.).
Agreement executed on behalf of Kerr County by County Judge,
Gordon S. Morriss.

GORDON, I am attaching the following documents relating to
the above referenced project:
Standard Form of Agreement Between Owner and Contractor
List of Clark & Stroman's proposed Subcontractors
Certificate of Insurance
Irrevocable Letter of Credit from NBC Bank Boerne
Letter from Clark & Stroman regarding extension of bid amount
time.
It is our understanding that these documents will complete the
requirements necessary for Kerr County to enter into an Agreement
with Clark & Stroman for construction of the above referenced
project. County Attorney Cary Kersey instructed us to proceed
based upon the substitution of the Letter of Credit in lieu of
statutory requirement of Performance & Payment Bond for public
work in excess of $25,000.00.
We recommend the Certificate of Insurance be reviewed by your
insurance counsel. By copies of this letter, we are submitting
these same documents to the persons listed below. Please contact
us if there are questions or clarification is needed.

ARTICLE 2

ARTICLE 3
TIME OF COMMENCEMENT AND SUBSTANTIAL COMPLETION

written Notice to Proceed
and, subject to authorized adjustments, Substantial Completion shall be adticved not later than ninety calendar

Liquidated damages are herein established in the amount of Fifty
Dollars ($50.00) per calendar day for each calendar day after the
agreed date for Substantial Completion that the Work is not fully
certified by the Architect as being Substantially Complete as
defined in the Conditions of the Contract.
Owner may offset any such liquidated damages for such delay against
any sums from time to time due by Owner to Contractor under the ..
Contract Documents.

CONTRACT SUM

deductions by Change Order as provided in the Contract Uocumenls, the Contract Sum of twenty-Seven
thousand four hundred three dollars ($27,403.00)
The Contract Sum is determined as follows:

Base Bid: Twenty-seven thousand four hundred three dollars ($27,403.00)
The percentages used to cover Overhead and Profit in determination
of costs for Changes in the Work, as described in the General
Conditions, Article 12, shall be as follows: For work performed
by Contractor's own forces, 15°a; for work performed by Subcontractor
and supervised by Contractor, 10~.
ARTICLE S
PROGRESS PAYMENTS

by the Archittct, the Owner shall make progress payments on account of the Contract Sum to the Contractor as pro-

FINAL PAYMENT

To The Honorable Judge Morris & Commissioners Court
Clark & Stroman will extend their bid amount time to
august 8, 1886 for the convenience of the Courthouse trial
still in progress, However, if we can enter into a contract
at this time we could lock in our subcontractors and sup-
pliers without concern of price increases. Tt would also
allow our plumbing contractor to order his fixtures which will
take more time than ordinary due to the type they are.
'•,~e would still not anticipate starting the job untill
the above date. However, we would anticipate payment for
any materials by ourselves or subcontractors that would be
purchased based on monthly draws.

Boerne, Texas, Letter of Credit #238, dated July 9, 1986", and the amounts drawn
must be endorsed on the reverse hereof by the negotiating bank or bankers.
All drafts must be accompanied by a written certificate sffiting that Clark
& StranazZ ~S1Strl1Ct10Sl, Inc. has failed to pay in accordance with the terms extended
by Kerr County.
