V. ROBISON AND WIFE, LEIGHRUIE ROBISON, as to whether or not the division of 10.9 acres out of Turtle Creek Ranches, located in Kerr County Commissioner's Precinct No. One, would be considered a subdivision, under the Kerr County Subdivision "RULES AND REGULATIONS". Said tract of land adjoins a 24.92 acre tract owned by Robert Burgess and Mr. Burgess would like to purchase 9 acres out of the 10.9 acre tract from Mr. & Mrs. Robison. Both tracts of land are served by Backacher Road. Motion made by Commissioner Holland seconded by Commissioner Lich and unanimously approved and determined by the Court that said division of property does not need to meet the require- ments of the Kerr County Subdivision "Rules and Regulations". The Robisons own a 10.9 acre tract of land, more or less, in what is commonly known as Turtle Creek Ranches, In 1980 they sold a 24.92 acre tract of land, which adjoins their 10.9 acre tract of land, to Robert Burgess. Mr. Burgess now wants to purchase approximately 9 acres of said 10.9 acres. Both tracts of land are served by Backacher Road. Since this involves a sale to an adjoining landowner and does not create any new tracts, but rather just reassembles two (2) existing tracts, we submit that this a permitted exception to the subdivision ordinance and request that the court enter an order finding that such conveyance does not need to meet the requirements of the Kerr County Subdivision °'Rules and Regulations".
