Kerr County Courthouse Kerrville, Texas 78028 Dear Judge Morriss: In order to improve the efficiency and effectiveness of law enforcement within the corporate limits of Ingram, Texas, particularly with regard to the administration and application of its traffic laws, the City of Ingram would like to assume law enforcement jurisdiction over that portion of Highway 27 right-of-way adjacent to its city limits, commencing near the intersection of Highway 27 and Woodland Road and continuing to the intersection of Highway 27 and Goat Creek Cutoff Road. Accordingly, the City of Ingram extends to Kerr County the offer to enter into negotiations, the final purpose of which would be an agreement authorized by the Interlocal Cooperation Action, Vernon's Ann. Civ. St., Article 4413 (32C). My reading of Section 4b of the Act authorizes annual, renewable agreements for contracts for the performance of any governmental function or service which all parties to the contract are legally authorized to perform. Section 3(2) of the Act includes police protection within the authorized subject matter of such agreements. The City of Ingram would be willing to exercise law enforcement jurisdiction to said portion of Highway 27 solely, or concurrently with Kerr County. I have discussed this matter with Sheriff Greeson, who interposed no objection. Please present this matter to the Commissioners Court for their consideration. Should the Court be in favor of pursuing further negotiations aimed at the specific provisions of such an agreeemnt, an interlocal contractual agreement should include the purpose, terms, rights, objectives, duties and responsibili- ties of the contracting parties.
