They are requesting an interpretation of the County Subdivision Regulations and/or two (2) variances from the County Subdivision Regulations. This property was divided due to the fact of a threatened foreclosure and the necessity for the members in the Joint Venture to finance their interest and avoid the foreclosure. They decided they wanted land owned solely by each individual. An existing paved road and easement served several of the tracts. This road (as well as the subdivision) was desiyred to preserve the a esthetic features of these properties and as a private, high security property. Land divisions were made to the center of this private road easement, which is to be maintained by the owners of these properties. We request the variance from Section 8.O1.D, "ROW limits shall be contiguous with lot lines". We believe that all the points of Section 5 exist due to properties being conveyed to the center. Also, we request that the private road and security be maintained by the owners, not opened to the public and thus no County repair and maintenance. This may involve a variance or an interpretation but should be annotated on the plat as private roads - similar to what the City of Kerrville requires. We also request a variance from Section 8.02.1.2C "Minor street shall have ... shoulder to shoulder width of 28 feet, and t a paved surface width of at least 20 feet." The existing road has a 12 foot wide paved surface, it serves only two residences and four tracts. With the economy at the e~:isting stage, this road cannot be widened at this time. We strongly recommend this variance and believe this variance falls within the requirement in Section 5. As pointed out, we also request an interpretation of the regulations permitting private roads to allow the existing ~I roads. This situation was not brought about by any particular party but by hard times and threatened foreclosure. Therefore, it would appear to be in everyones best interest to allow the proposed plat as stated and to not jeopardize the possible i foreclosures of these properties, which would put the land in an uncertain and undesired state.
