ORDER NO. 17326 ORDER AUTHORIZING UGRA TO ACT AS THE MANAGING AGENT FOR FILING APPLICATION TO OBTAIN A GRANT, FUNDING COST OF STUDY RE: IMPROVING AND/OR CORRECTING THE WASTE DISPOSAL PROBLEMS EXISTING IN KERRVILLE SOUTH On this the 22nd day of June 1987, upon motion made by Commissioner Ray, seconded by Commissioner Lich, with Commissioners Ray, Lich, Baldwin, and County Judge voting "AYE" and Commissioner Holland "ABSTAINING FROM VOTING", said motion passing by a majority vote, the Court authorized UGRA (UPPER GUADALUPE RIVER AUTHORITY) to act as the managing agent for the filing of an application to obtain a grant, funding the cost of a study to determine the alternative available means of improving and/or correcting the waste disposal problems existing in Kerrville Southi and further ordered by the Court that the County Judge, Danny R. Edwards, is authorized to direct a letter to UGRA to this effect. ' • R i i'' 9 J une 1987 Dear Sirs: Continuing problems with on site waste disposal in the unincorporated area of Kerrville South have established a need for positive action to alleviate failing septic systems, potential public health hazards and pollution of Camp Meeting Creek. The construction of a central sewage collection system is thought to be the best approach to solving the .waste water disposal problems in Kerrville South. A logical service 'area would be the natural drainage basin of Carnp Meeting Creek to Highway 16. It is the understanding of Commissioners' Court that planning and construction grant funding is available through the • Environmental Protection Agency far sewer collection projects in unsewered communities. While the Court is interested in promoting a central sewage collection system to solve • existing on site disposal problems, we realize that Counties are ~-ot eligible for E. P. A. grant funding. Brune General Manager I am writing this letter to clarify certain issues regarding the proposed study of a comzntnity sewer collection system in the Kerrville South area. In April of 1987, the UGRA Board of Directors authorized staff to canvas certain governmental agencies and C.A.G. to determine their interest in acting as the managing agent for participation in an E.P.A, grants program now available for qualified participants with sewer collection and/or treat- ment projects which meet E.P.A, criteria for innovative or alternate design. At that time, the UGRA Board indicated that it did not necessarily want to be the managing agent, but would consider the undertaking if requested by the other parties, due to the seriousness of the problem with failing on-site waste disposal systems and resulting threat to the water quality of the Guadaluptr River. Please realize that the innovative and alternate approach to sewering the Kerrville South area was chosen because (1) up to 75$ of the total project cost can be funded by E.P.A.; (2} the project, if accepted, is 100$ backed by E.P.A., that is to say if the as-built project has problems, the E.P.A. will bear the cost of fixing them. At this time, I am unaware of any other funds or grants available at the Federal, State, or local levels of govern- ment to plan or implement com~tunity sewer projects. The E.P.A. film I have included provides comparisons of conventional sewer collection lines and the small diameter effluent sewer from the standpoint of initial costs, neighborhood impact, aad long-term maintenance. I hope you will review it. It is our opinion that the drainage basin of Camp Meeting Creek to Highway 16 is a logical service area for a community sewer project. This 9.5 square mile area could be broken dawn into smaller areas or project phases during the planning step of the grant. The feasibility of this large an area will, I'm sure, be addressed during the planning step of the project, as will the capacity of the ten-inch City sewer line under construction to serve the Nimitz Elementary School. With City approval, the proposed Kerrville South collection system could be connected to this line and conveyed to the City's municipal sewer treatment facility which will have increased capacity and treatment levels in the short term. ' ~_ I ~~ ~/ • 'R Board of Directors Community Action Group, Inc. Page 2 6-11-87 In our opinion, the study of an alternate sewer project could be done at no cost to the citizens of Kerrville South. The E.P.A. grant program is broken down into three steps: (1) Planning, (2) Engineering, and (3) Construction. Steps 2 and 3 have been recently combined by E.P.A. The planning step, including definition of service area, involves an inventory of present environmental conditions and a physical inventory of population dynamics and distribution, All alternatives are assessed from the standpoint of feasibility, cost comparison, and environmental impact, including (1) leav- ing septic systems in place; (2) conventional gravity sewer collection; (3) small diameter variable grade sewer collection: and (4) other alternatives. At the end of the planning step, the citizens of the service area will be provided extensive information regarding alternatives, costs, and monthly service fees, We are of the opinion that the entire project cost can be provided by a monthly service fee. Before grant applications are submitted for Steps 2 and 3, a referendum election would be held to determine if the people in the service area want to do the project. We feel that for the short and long-term needs of the community, the Innovative and Alternate Sewer Grants Program funded by E.P.A. should be investigated, but before a planning step grant can be submitted, a managing agent must be chosen, I have enclosed a draft letter for the Kerr County Judge's signature which requests assistance in going forward with an E.P.A. sewer planning study. I am requesting that C.A.G. make their comments regarding the managing agent to the Commissioners Court. BOX 124, KERRVILLE, TX 78029 512/896-8028 RESOLUTION WHEREAS, an extensive area south of the Kerrville city limits and along either side of Texas Highway 16 South has been platted with subdivisions too numerous to name individually, but comprising upwards to 1,000 residences; and, WHEREAS, said platted areas have less than forty percent (4096) of the lots with residences built on them; and, WHEREAS, said area contains lot sizes ranging from about one-fourth acre to ten acres or mare with the predominant size being of one-half acre to two acres; and, WHEREAS, these large plot residences are an essential feature of living in the beautiful hill country; and, WHEREAS, said area also contains numerous other lots substan- tially smaller; apartment complexes and mobile home parks; thus creating a very high density of septic tanks; and, WHEREAS, competent county authority has set forth rules and guidelines for sewage disposal in said area through a septic tank system and attendant regulations; and, WHEREAS, said septic tank systems in selected areas of high density are known to emit an effluent of undesirably high BOD content; thus starting the process of polluting the environment; and, WHEREAS, approximately 85% of the septic tank systems are believed to function adequately; and, WHEREAS, several proposals have been made by county authorities to alleviate said pollution, among which are: (1) Municipal Utility District (MUD), and (2) Smail diameter variable-grade gravity sewers; and, WHEREAS, the maintenance of adequate water supplies and proper disposal of sewage and wastewater are items of high priority in the Environmenal Control policies of the State of Texas and the nation; and, WHEREAS, it is to the benefit of all parties having an interest in living in beautiful Kerr County that an effective and sound system be adopted to handle wastewater disposal in an environmentally constructive yet economical way. NOW THEREFORE, be it resolved that the Community Action Group, Inc., does hereby petition the County Commissioners Court to establish a task force to study, evaluate, and recommend a comprehensive long term program and master plan for disposal of sewage and wastewater in the above referenced platted area. Such study should include, but not be limited to: 1. Overall sewage needs for the platted area, assuming that 80% of the lots have residences. 2. The technical adequacy of existing septic tank regulations. 3. The extent of the future suitibility of the septic tank system and the controlling parameters. 4. Maintenance regulation for septic tanks. 5. Preservation of the environment, including the concept of large lot subdivisions, 1/2 to 10 acres. 6. Provision of wastewater disposal methods suitable for high density dwellings. 7. Environmental sound alternatives to conventional sewage treatment plants. 8. Adequacy of state laws and regulations relating to the special needs of wastewater disposal in Kerr County. 9. Involvement of the total community and the interest of all persons residing in the area or having an economic interest. Be it further resolved that this resolution be presented to the County Commissioners Court at the first open date by a delegation from CAG, Inc. Passed by unanimous vote 6th day of April, 1987.
