Kerr County, Texas, and that said release be recorded in the Kerr County Commissioners' Court Minutes. MUTUAL RELEASE 1. In consideration of $10.00 cash and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, and the mutual covenants and promises hereinafter set forth, Jack Stone and his wife, Patricia C. Stone, of Kerr County, Texas, hereby agree and covenant as follows: A. That Jack Stone will file and present to the Court a Motion to Dismiss with Prejucice, that certain lawsuit now pending on the docket of the 216th District Court of Kerr County, being Cause No. 86-155-A and styled Jack Stone v. Kerr County, Texas, and will bear all costs incurred by him in connection therewith. B. That Jack Stone and Patricia C. Stone hereby fully and finally release Kerr County, Texas, Cave Spring Owners, Inc., SPH Construction, Canyon Springs Ranch, Inc., Walter B. ! Hailey, Jr., W. R. Skinner, and D. D. Patteson, from any and all claims now or hereafter i to be asserted arising out of the purchase by Jack Stone and Patricia C. Stone of Lots 406A and 407, Cave Springs Addition, Section Four, a subdivision of Kerr County, Texas, according to the map or plat thereof filed of record at Volume 4, Page 147, of the Plat Records of Kerr County, Texas, and replatted by Order No. 16279 of the Commissioners Court of Kerr County, Texas, and filed of record as amended at Volume 5, Page 165 of the Plat Records of Kerr County, Texas, and waive and release any and all claims against said parties arising from any transactions, actions, or litigation prior to the date hereof. 2. In consideration of $10.00 cash and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, and the mutual covenants and promises hereinabove and hereinafter set forth, Kerr County, Texas, Cave Spring Owners, Inc., SPH Construction, Canyon Springs Ranch, Inc., Walter B. Hailey, Jr., W. R. Skinner, and D. D. Patteson, of Kerr County, Texas, hereby agree and covenant as follows: A. Kerr County and Cave Spring Owners, Inc., agree to withdraw and dismiss all pending and/or contemplated motions or requests for sanctions, attorneys' fees, or other claims asserted or to be asserted against Jack Stone and/or Patricia C. Stone and/or any member of either of their immediate families in the above-referenced pending lawsuit, and to bear all costs by them, or either of them, incurred in the said lawsuit. B. Kerr County, Texas, Cave Spring Owners, Inc., SPH Construction, Canyon Springs Ranch, Inc., Walter B. Hailey, Jr., W. R. Skinner, and D. D. Patteson, and all and each of them, hereby waive and release any and all claims they may have against Jack Stone, Patricia C. Stone, and/or either of them and/ur any member of either of their immediate families arising from any transactions, actions, or litigation prior to the date hereof.
