M., with the following members present: FRED HOLLAND Commissioner Precinct 1 BILL RAY Commissioner Precinct 2 VICTOR LICH Commissioner Precinct 3 H. A. BALDWIN Commissioner Precinct 4 Commissioner Victor Lich served as Presiding Officer of the Court in the absence of County Judge Danny R. Edwards, and the Court having duly opened, the following proceedings were had: N0. 17201 AN ORDER ESTABLISHING A DEVELOPMENT PERMIT SYSTEM AND ADOPTING REGULATIONS REQUIRING DEVELOPMENT PERMITS FOR CONSTRUCTION IN FLOOD PLAIN AREAS HAVING SPECIAL FLOOD HAZARDS, PROVIDING FOR REVIEW OF SUBDIVISIONS, PROVIDING FOR ADMINISTRATION AND ENFORCEMENT OF THE REGULATIONS, AND MAKING PROVISIONS, RELATED TO DEVELOPMENT WITHIN THE COUNTY'S DESIGNATED FLOOD PLAINS STATE OF TEXAS: COUNTY OF KERR: WHEREAS, the Commissioners Court of Kerr County is the governing body of Kerr County, Texas; WHEREAS, the County of Kerr wishes to establish in the National Flood Insurance program and in order to do so must meet the minimum requirements of Section 60.3(b) of the Program Regulations as published by the Federal Emergency Management Agency, and; WHEREAS, under the National Flood Insurance Act of 1968, as amended, residents of Kerr County can qualify for flood insurance coverage if Kerr County adopts and enforces flood plain management criteria consistent with the need to establish minimum development standards within unincorporated land areas designated as flood prone by the U. S. Department of Housing and Urban Development; WHEREAS, under Subchapter I, Section 16.313 of the Texas Water Code, Counties are defined as authorized political subdivisions of the State; WHEREAS, under Subchapter I, Section 16.315 of the Texas Water Code, all political sub- divisions are authorized to take all necessary and reasonable actions to comply with the requirements and criteria of the National Flood Insurance Program; WHEREAS, the Commissioners Court desires to establish a development permit system and draft regulations to implement and enforce the system to qualify and maintain the eligibility of residents in the unincorporated areas of Kerr County to purchase federal flood insurance; WHEREAS, the development permit system and regulations as drafted, require certain duties of officials of Kerr County and; WHEREAS, the Commissioners Court of Kerr County has considered the regulations as drafted and desires to adopt them as the official flood plain management regulations of Kerr County, and; WHEREAS, a copy of the regulations as drafted are attached hereto, and are by reference incorporated in, and made a part of, this Court Order; NOW, THEREFORE, on this 31st day of March 1987 in a meeting of the Commissioners Court of Kerr County, Texas, duly convened and acting in its capacity as governing body of Kerr County, the following members being .present: DANNY R. BALDWIN , Commissioner, Precinct No. 4 3 86 on motion of Commissioner Ray, seconded by Commissioner Holland, duly put and carried, it is ORDERED by the Commissioners Court of Kerr County, Texas, that the regulations attached and i appended hereto, a part of this Order and are adopted as the regulations of Kerr County, and all officials of Kerr County having duties under said regulations are ORDERED and DIRECTED to perform such duties as required of them under said regulations. DAVIS AS A MEMBER TO THE KERRVILLE-KERR COUNTY JOINT AIRPORT ADVISORY BOARD On this the 31st day of March 1987, upon motion made by Commissioner Ray, seconded by Commissioner Holland, the Court unanimously approved the appointment of DR. JOHN D. DAVI5 as a Member to the Kerrville/Kerr County Joint Airport Advisory Board. o-o-o-o-o-o-o-o-o-o NO. 17203 RESOLUTION WHEREAS, the Juvenile Probation Department of Kerr County, Texas, has requested funding for a project known as "JUVENILE DETENTION STAFFING" to aid in the duties of that department, and WHEREAS, funding is available for such a program through the Governor"s Office of General Counsel and Criminal Justice and the Juvenile Justice Delinquency Prevention Act for 38°s of the (project amount, and I i ~'~ WHEREAS, the involvement of juveniles in delinquency and crime is of concern to this body and deserves the attention of our Criminal Justice System; NOW, THEREFORE, BE IT RESOLVED that the Commissioners' Court of Kerr County hereby ', approves the submission of a grant application entitled "JUVENILE DETENTION STAFFING" in the amount of $35,313.00 through the Alamo Area Council of Governments to the Governor's Office Hof General Counsel and Criminal Justice, State of Texas.
