Denson Ken County Judge Kerr County Courthouse Kerrville, Texas 78028 Dear Judge Denson and Members of the Court: UGRA and HUWCD have significant interest in any revision to the Kerr County Subdivision Platting Order and would like to participate in that process. Our immediate interest centers around platting notes, more specifically the opportunity for HUWCD's water well licensing and regulation program and the inclusion of the appropriate platting notes and signature line. Also included in the immediate interest group is the floodplain management review and the appropriate platting notes. UGRA has been inundated with high-end building requests in West Kerr County. Most of these requests are in subdivisions where floodplain and basic floor elevations range from sketchy to non-existent. We would ask the Court's consideration for immediate authorization to include the above platting notes on all subdivision plats filed from the date of the Court's action forward. We are attaching sample copies of the plat notes for your consideration. HUWCD "Authorization to drill, replace, alter, equip, or transfer ownership of a water well, public or private, must be obtained from the Headwaters Underground Water Conservation District prior to drilling a water well and producing water ~ therefrom." FLOODPLAIN MANAGEMENT The existing Plat Notes for Floodplain Management as listed on page 23 of the Kerr County Subdivision "Rules and Regulations", January, 1984, are as follows: "I hereby certify that the subdivision platted hereon is or is not within the 100- year floodplain." "Minimum finished floor elevation for all affected structures shall be equal to the elevation of the 100-year floodplain as shown hereon: X~~' M.S.L. (Minimum Finished Floor Elevation will be shown inside a box with the designation of `M.S.L.' mean sea level.)" "Kerr County Development Permit is required prior to any site development within the 100-year Floodplain." Attached to that request was a UGRA internal memorandum dated March 24,1997, with some suggested plat notes. The March 24~' memorandum omitted the HUWCD review signature for that part of the process. We are attaching a second internal memorandum that more correctly reflects what we believe to be the appropriate format for the platting notes. We also suggest a conference with the appropriate county officials to discuss any concerns you may have and subsequently place the item on the Court's agenda for public presentation and action.
