KERSEY County Attorney r GEK/sara Enclosure as stated STATE OF TEXAS X COUNTY OF KERR X CHILD WELFARE CONTRACT The Texas Department° of Human Services hereinafter referred to as the Department, and the Commissioners' Court of Kerr County, Texas, hereinafter referred to as the County, do hereby make and enter into this contract to establish a county-wide, jointly financed, state administered, and regionally operated child welfare program as set forth below to meet the needs of children in the county who are in need of protection. The Department and the County agree that the child welfare program shall be neither a probation nor a•general relief program and the Department's child welfare staff, hereinafter referred to as the staff, shall not be considered a part of law enforcement. The Department and the county enter into this contract under the authority of Title IV of the SociaY Security Act, as amended, which authorizes the federal government to expand the child welfare program and which has made available federal funds to enable the Department to extend its child welfare program: Further, the Human Resources Code designates the Department as the state agency to cooperate with the federal government in the administration of the provisions of Title IV of the Social Security Act, as amended, and to cooperate with the appropriate department of the federal government and with other departments of the state and local governments in the administration of such provisions; and under the authority of Section 41.002, Human Resources Code; which authorizes the Department to enter into contracts with counties for the extension of the foster care program to certain children ineligible for AFDC foster care or state-paid foster care. II. The County agrees: A. To appoint a Child Welfare Board, hereinafter referred to as the Board, as set out in Article III of this contract. 1 B. To establish and maintain, pursuant to its responsibility for the support and maintenance of indigent children under Tex. Rev.' Civ. Stat. Ann., Art. 2351, Section it (Paupers), funding which will pay the cost of board and care for children up to 18 years of age who, (i) are in need of protective care, and (ii) qualify for county support under Tex. Rev. Civ. Stat. Article 2351, Section il, ,and (iii) are under the conservatorship of the department. The children for whom such funding will be expended shall meet the requirements set out above and shall placed in one or more of the following classes: 1) Children who are not eligible for AFDC foster care or state-paid foster care. 2) Children who are not eligible for Medicaid. 3) Children who are eligible for either AFDC foster care or state-paid foster care or both. 4) Children who are eligible for Medicaid. Expenditures made for foster care by the County for a child1 who is ineligible for AFDC foster care or state-paid foster care can not be less than expenditures made for foster care services for a chid by AFCD foster care or state-paid foster care for the same service. Expenditures made for medical care services by the County for a cold who is ineligible for Medicaid can not be less than expenditures made for medical care for a child by Medicaid for the same services. C. To provide funds for the child-care services listed in Exhibit "A" which are in addition to the obligations of the county set out hereinabove. Exhibit "A", attached hereto, lists the specific child-care services and/or facilities which the County agrees to provide including obligations of the County set out hereinabove, and is incorporated into this contract in its entirety by specific reference: Any changes, modifications or amendments thereto must be made with the prior written approval ,of the County and the Department. D. None of the monies provided to the Department pursuant 2 to the terms of this contract shall be federal funds, either directly or indirectly,' and County further agrees that such monies have not been used to secure federal matching funds previously. Revenue sharing funds may be used by County to meet . its obligation herein. E. To maintain and retain fiscal records adequate to assure that claims for Federal and State funds are in accord with applicable requirements. Said fiscal records shall be maintained and retained by the County for a period of three (3) years and ninty {90) days after the date of the end of the federal fiscal year in which the transaction occurred. In the event that an audit by or on behalf of the U.S. Department of Health and Human Services occurs, fiscal records will be retained until the resolution of audit questions. F. The County agrees to maintain its total net budget • appropriation for obligations of the County found herein for any future fiscal year at: 1.) the level of the County's budget appropriation to mebt County's obligations hereunder for the fiscal year preceeding the signing of this contract, or 2.) the County's actual expenditures for the County's obligations hereunder for the fiscal year preceeding the next succeeding budget year, Whichever is less. G. The total of the expenditures to be made hereunder will be limited to the approved fiscal year budget appropriation for the items outlined above, unless prior approval from the Commissioners' Court is obtained.' III. The Board, required under Article II, Section A of this contract will consist of seven to fifteen persons appointed by the Commissioners' Court. Each member of the Board will serve a three year term on a rotating basis. The County shall initially 3 appoint one-third (1/3) of the members of the Board for a one (1) year term, one-third (1/3) for a two year term and one-third (1/3) fora three year term. Ninety days prior to the expiration of any members term, the Comtrlissioners Court will be notified in writing by the Board of the name of any member whose term is expiring and the date on which said term will expire.. The Commissioners Court shall appoint the successor. member within thirty (30) days prior to said expiration date. Nothing herein shall prevent board members from serving successive terms. The Board shall have and exercise such lawful authority, duties and responsibilities as maybe lawfully conferred upon it by statute, the Department and the County. The Department and the County agree that the Board will have, at a minimum, the following duties: 1. Raise funds for child welfare purposes. 2. Explain the child welfare program and needs to the community and explain to Department staff the community's conditions and attitudes on policy, services, and priorities. 3. Coordinate the development of local agreements as needed with other community agencies serving children, such as juvenile . probation, MH/MR, school boards,. hospital boards, family service and child guidance agencies, and licensed child-caring and child- placing agencies. 4. Develop policy, consistent with Department policy and requirements set ot~t in this contract, related to the expenditure of county funds. Such policies to be in writing and approved by the County. 5. Authorize administrative staff of the expend county funds for purposes for which appropr however to delegation by County authority to expenditure of such funds. 6. Authorize administrative staff of the expend any other funds under control of the Board for child welfare purposes in accordance with Department to sated, subject authorize the Department to (Board funds) the policies, 4 duties and authority of the Board. ?. Review on a monthly basis: i 1.) receipts .for expenditures for child welfare for which reimbursement is requested. 2.) bills for `child welfare expenses for which payment is requested.. To the extent Board funds are available, the Board will pay such bills or make such reimbursement provided however, the Board shall not be required to pay bills or make reimbursement for items for which the County may obtain reimbursement from AFDC, state paid foster care or Medicaid. Nothing herein shall prevent the Board from paying bills or making reimbursements for items for which the County may obtain reimbursement from AFDC, state paid foster care or Medicaid, if such funds are available. 8. All bills or requests for reimbursement which are not paid by the Board shall be immediately forwarded to the Auditor after Board review. The auditor shall: 1.) Review and approve all bills and reimbursement requests which are obligations of County under the terms of this contract. 2.) Submit all approved items to the County Commissioners Court for payment authorization. 3.) Certify vouchers for payments made by County which are to be reimbursed~to County by AFDC foster care, state paid foster care or Medicaid. 4.) Return to Department for reimbursement: A.) Certified vouchers B.) A statement in the format prescribed by the Department which meets department regulations for children eligible for AFDC foster care, state-paid foster care of Medicaid reimbursement to County. IV. The Department agrees: A. To provide Title XIX Medicaid coverage within the amount, duration, and scope of the Medicaid program as available 5 to the Department, for any child who is eligible for Medicaid benefits. ' B. To provide and administer state and /or federally funded financial benefits for eligible children receiving services contemplated by this contract, including but not limited to, AFDC foster care, state-paid foster care and Medicaid. C. To reimburse the County by payment to the County for reimbursable AFDC foster care, state-paid foster care, Medicaid and any other reimbursable payments made by the County for those children certified as eligible for such reimbursement. Upon receipt of a verified voucher from the County in accordance with the fiscal procedures of the Department, reimbursement will be made to the County for payments made by the County in the preceding month, which are eligible for reimbursement. The Department agrees to reimburse the County after the effective date of this contract on a month-to-month basis with adjustments for overpayments or underpayments made for previous months. D. To reimburse the Board by payment to the Board for reimbursable AFDC foster care, state paid foster care, Medicaid and other reimbursable payments. made by the Board for those ` children certified as eligible for such reimbursement. Upon receipt of a verified voucher frpm the Board in accordance with the fiscal procedures of the Department, reimbursement will be made to the Board fvr payments made by the Board in the preceeding month, which are eligible for reimbursement. The Department agrees to reimburse the Board after the effective date of this contract on a month-to-month basis with adjustments for overpayments or underpayments made for previous months. E. To provide and administer child welfare earned funds and other funds for special projects based on the availability of the funds, the statewide need, and the state anti federal policies regarding the use of these funds. F. To receive and expend children's personal funds (SSI, SSA, child support, etc.), in accordance with the needs of each 6 ' child and on authorization of the Board. G. To provide for the County's use forms for financial and statistics reporting required under the terms of this contract. H. To the extent federal funding is available, the Department agrees to reimburse the County for up to one-half the cost of legal representation of those children residing in the county, in the suits brought by the Department in which the Department is seeking conservatorship. Provided however, that such reimbursement by the Department shall not exceed any dollar amount limit set for that fiscal year. V. The Parties Mutually agree: A. That this mutually undertaken "child welfare program" must meet state licensing and/or certification standards for child-caring and, child-placing activities as a condition to continuation of this contract. B. That there shall be no discrimination in employment, • service, or dismissal because of race, color, religion, sex, or national origin. The Federal Civil Rights Act of 1964, as amended, TEX. REV. CIV. STAT. ANN., 'Art. 6252-16, as amenddd, Executive Order No. 11246 entitled "Equal Employment Opportunity" as supplemented in 41 CFR., Part 60, and the Rehabilitation Act of 1973, Section 504, shall be compiled with in all respects. C. That there shall be an annual review of this contract conducted jointly by the County and the Department in order to evaluate the program and consider any appropriate changes. A written report of the findings of the annual contract review shall be prepared, and formally approved by the County and the appropriate Department regional administrator, to include annual budget approval. D. That the term of this contract shall be for a period begining on the effective date and will terminate at such time as the federal, state, or county governments cease to participate in the program, by mutual consent of all parties hereto, or upon breach of the contract by one of the parties hereto. If mutual 7 consent cannot be attained, either party to this contract may consider it canceled by giving thirty (30) days notice in writing to the other party, and this contract shall thereupon be canceled upon the expiration of such thirty (30} day period. It is further agreed and understood that in the event the federal or state laws or other requirements should be amended or judicially interpreted so as to render fulfillment of this contract on the part 'of either party unfeasible or impossible or if the Department and the County should be unable to agree upon modifying amendments which would be needed to enable substantial continuation of the program as a result of such amendments or judicial interpretations, then, anc~ in that event, the Department and the county shall be discharged fromfurther obligation created under the terms of this contract, except for the equitables settlement of the respective accrued interests or obligation incurred up to the date of termination. . E. That this contract shall constitute the entire agreement of the County and the Department, and supersedes any other agreements}, contracts}, or amendments} whether formal or informal, which have been previously entered into by and between i the County and the Department relating to the services covered under this contract. For the faithful performance of the terms of this contract, the parties hereto, in their capacities as stated, affix their signatures and bind themselves effective the day of 1987. STATISTICAL BACKGROUND FOR EXHIBIT A The information on each line of Exhibit A was obtained from the following sources: L. FOSTER CARE EXPENSES AFDC - Please review Items 1, 2, 3, 4, and 5 attached. Items 1, 2, 3, and 4 are the actual expenditures on foster care for Kerr County children made during the stated fiscal year. During the past four (4) years in Kerr County we have not removed a child who was not eligible for AFDC State Paid Foster Care. Therefore, 100$ of the expenses for the past four years was eligible for reim- bursement. In Bexar County and some other rural counties where there are Boards, statistics show that it can be anticipated that at least 80$ of the foster care expenses are reimbursed to the County. Although the recent statistical history in Kerr County indicates we can anticipate 100 reimbursement, 80~ was used for the purpose of this budget. We cannot anticipate the future need to request the removal of a child who will not be eligible for AFDC State Paid Foster Care. Item 6 attached is the AFDC Daily Rates. ' Item 5 is the number of children in DHS managing conservatorship during the past three (3) years. The number is decreasing, but the removal of one sibling group can significantly change these statistics. The average number of children in our conservatorship during the past three (3) years was 13. The average daily rate for care for these children is $10.00 per day X 365 days = $47,450. The average foster care expenditures during the past four years was $56,461. We rounded off this figure to $56,000*. Z,. VOLUNTARY PLACEMENTS - Voluntary placements are sometimes made by parents who have no relatives or friends available to care for their children when they are incarcerated, detained or hospitalized. In these cases the parents agree to place their children temporarily (no more than 30 days). They also agree to give some support for the child during this placement. In the event that we place the child in a DHS foster home with such an agreement we want to pay the foster home the approved daily foster care rate. Based on situations in the other three (3) rural counties in my unit, I estimate this could be four (4) voluntary placements per year at $300 per placement X 4 = $1,200. 3. OUT OF STATE PLACEMENTS - Rarely are we involved in out-of-state placements where we are required to pay foster care, but it has happened. We have an agreement with the Interstate Compact for Child Placing Agencies (ICPC) that if we have conservatorship and return posessory conservatorship to the parent in another state through ICPC, we will pay for the child's foster care, should they be removed from the parent in that state. In my unit, this has occurred twice during the past three years. Once with one child and once with a sibling group of three. Therefore this is a situation that should be planned .~ STATISTICAL BACKGROUND FOR EXHIBIT A PAGE 2 for in the budget for Kerr County. I estimate a possible need for four (4) placements per year ~t $300/month for approximately six (6) to nine (9) months = $10,800** CLOTHING - I based this figure on a yearly allowance of $200 per year for clothing of an average of 13 children in care during the year, 13 X $200 = $2,600. MEDICAL, DENTAL & OPTOMETRIC - I based this expense on the needs of all children in my unit which have arisen over the past year. I considered other children in the unit because I cannot, anticipate what types of situations will arise just in Kerr County. I reviewed previous requests and rounded off to come up with the figure $1,000. MISCELLANEOUS - This would include pictures for a Life Book prior to going into adoption, summer camp expenses, travel to family visits, certified copies of birth certificates, and senior rings. Other things could arise which might fit into this category. They could be reviewed at the time. These are the things that we have needed a resource for during the past three years. I estimate the need to be $500. The Total anticipated budget need would be $72,000 with at least $45,000 being reimbursed by the State leaving the County expenditure at $27,100. *In the past three years in Kerr County the children removed, all qualified for State Paid Foster Care, which would give the County 100$ reimbursement. . However, future situations may be different. **In the past three years in Kerr County the need for funds for out of . state placements has not arisen. ~ ITEM 1 !
