MOTION TO APPROVE ORDER AS ORIGINALLY PRESENTED TO THE
COMMISSIONERS' COURT ON MAY 11th, 1987 BY THE COMMITTEE
FOR CLEAN INDOOR AIR, WITH EXCEPTION OF THE EFFECTIVE
DATE
On this the 21st day of May 1987, a motion was made by
Commissioner Baldwin, seconded by Commissioner Ray,
with Commissioners Holland, Ray and Baldwin voting "AYE"
and Commissioner Lich and_County Judge Edwards voting
"NAY", said motion carrying by a majority vote, to approve
an order as originally presented to the Commissioners'
Court on May 11th, 1987, by the Committee for Clean Indoor
Air, with exception of the effective date, which will be
June 1st, 1987.

COUNTY OF KERR
ORDER
WHEREAS, the Surgeon General of the United States has
declared that smoking is the number one public health issu4~ of
our time; and
WHEREAS, the Kerrville City Council has adopted a Clean
Indoor Air Ordinance regulating smoking in public places and
places of employment; and
WHEREAS, facilities owned or maintained by Kerr County fall
outside the City's regulating authority with respect to this
Clean Indoor Air Ordinance; and
WHEREAS, the Commissioners Court of Kerr County recognizes
the increasing evidence that Smoke ~reatea a danger to the health
of some citizens, and is the cause of annoyance and discomfort to
those who are in confined spaces where smoke is present; and
WHEREAS, in order to protect the health and welfare of those
citizens, as well as to protect the rights of non-smokers, it is
necessary to restrict smoking on property owned or maintained by
Kerr County;
NOW THEREFORE, be it ordered by the Commissioners Court of
the County of Kerr that henceforth, the carrying or holding of a
lighted pipe, cigar or cigarette of any kind, or any other
. lighted smoking equipment or device, and the lighting of,
' emitting or exhaling the smoke of a pipe, cigar or cigarette of
any kind shall be prohibited in ell public buildings owned,
leased or maintained by Kerr County; provided that, this
prohibition shall not be effective in actual fail cells or
holding areas used for the confinement of county fail inmates.
' This order shall take effect on the 11th day of May, 1987.
