MOTION TO APPROVE ORDER AS ORIGINALLY PRESENTED TO THE
COMMISSIONERS' COURT ON MAY 11th, 1987 BY THE COM1~iITTEE
FOR CLEAN INDOOR AIR, WITH EXCEPTION OF THE EFFECTIVE
DATE
On this the 21st day of May 1987, a motion was made by
Commissioner Baldwin, seconded by Commissioner Ray,
with Commissioners Holland, Ray and Baldwin voting "AYE"
and Commissioner Lich and ,County Judge Edwards voting
"NAY", said motion carrying by a majority vote, to approve
an order as originally presented to the Commissioners'
Court on May 11th, 198?, by the Committee for Clean Indoor
Air, with exception of the effective date, which will be
June 1st, 1987.

WHEREAS, the Surgeon General of the United States has
declared that smoking is the nuaber one public health issue, of
our ties; end
WHEREAS, the Kerrville City Council has adopted a Clean
Indoor Air Ordinance regulating aaoking in public places and
places of employ~aent; end
WHEREAS, facilities owned or mointained by Kerr County f elf,

outside the City'$ regulating authority with respect to thin
Clean Indoor Air Ordinance; and
WHEREAS, the CommiBaioner8 Court ®f~Kerr County recognizes

the increasing evidence that smoke exeatea a danger to the health

of some citi2en8, and is the cause of annoyance end discomfort to
those who are in confined sparse where a~aoke is pr~raent; end
WHEREAS, in order to protect the health 8nd welfare of those
citizens, as well $s to protect the rights of non~amokera, it i~
necessary to restrict smoking on property owned or maintr~-ined by
Kerr County; .
NOW THHREFaRE, be it ordered by they Commissioners Court of
the County of Kerr that henceforth, the carrying or holding of a
r
lighted pipe, cigar or cigarette of any kind, or any other
lighted smoking equipment or device, and the lighting of,
emitting or exhaling the smoke of a pipe, cigar or cigarette of
any kind shall be prohibited in all public buildings owned,
leased or mai»tained by Kerr County; provided that, this
prohibition 8ha11 not be effective in +ectual veil cells or
holding areas used for the confinement of county ~dil inaates.
