On this the 10th day of November 1987, upon motion made
by Commissioner Baldwin, seconded by Commissioner Lich,
with Commissioners Ray, Lich and Baldwin voting "AYE"
and Commissioner Holland and Judge Edwards voting °'NAY",
said motion carrying by a majority vote, approving acceptance
of maintenance of Karen Drive and Elizabeth Drive in Valle
Verde Subdivision in Commissioner's Precinct No. Four,
with no commitment for hard surfacing of roads and minimal
maintenance during the next year, as recommended by Kerr
County Road Engineer Gerald W. A2enefee.

Mr. Milton W. Barrett, owner of Valle Verde Subdivision in Kerr
County, has contacted the undersigned in regard to the captioned
matter.
Mr. Barrett states that the Commissioner's court gave former
Precinct Four Commissioner, Billy Gutherie, the authority to
establish and require certain improvements to the Karen Drive and
Elizabeth Drive and that when such improvements were made, to
accept those roads on behalf of Kerr County, for county
maintenance. Mr. Barrett further states that he and Mr. Gutherie
met; that Mr. Gutherie outlined the required improvements; that
such improvements were made to Mr. Gutherie's specifications and
that Mr. Gutherie did accept the roads for county maintenance on
behalf of Kerr County. It is Mr. Barrett's understanding that
Mr. Gutherie's letter indicating such acceptance has been lost or
misplaced.
Mr. Barrett has recently verified the above with Mr. Gutherie.
Mr. Barrett further states that Mr. Gutherie has or will write
the Court to confirm the above.
This letter is to respectfully request that the Commissioners'
Court place this matter on the agenda for the Court's next
regular meeting, and that the Court reconsider the action taken
on the 14th day of September, 1987.

by Commissioner Ray and seconded by Commissioner Holland,
to table Item No. 3 - Consideration of maintenance for Karen
Drive and Elizabeth Drive, Valle Verde Subdivision, on the
Commissioners' Court Agenda for October 22nd, 1987.
Commissioners Holland and Aay and County Judge Edwards
voted "AYE" and Commissioners Lich and Baldwin voted "NAY",
said motion carrying by a majority vote, approving that
item No. 3 be tabled.
ORDER NO. 19047
APPROVAL OF PLAT OF VALLE VERDE
On this the 9th day of June 1980, upon motion made by
Commissioner Guthrie, seconded by Commissioner Garrett,
the Court unanimously approved the Plat of Valle Verde,
subject to the provisions that actual maintenance of road-
ways will not be assumed by Kerr County until residential
development shall justify said maintenance and until roads are
constructed to specifications of the Commissioner of Rerr
County Precinct No. 4.

Dear Gentlemen:
This letter is offered as confirmation of certain actions taken
by me in my capacity as county commissioner, Precinct Four, Kerr
County, during my terms of office, which relate to the captioned
matter.
On the 9th day of June, 1980, upon motion by the undersigned and
seconded by Commissioner Garrett, the Court unanimously approved
the Plat of Valle Verde, subject to the provisions that actual
maintenance of roadways in Valle Verde subdivision not be assumed
by Kerr County until residential development in Valle Verde
justified county maintenance and until the roads were constructed
to specifications of the Commissioner of Kerr County, Precinct No.
4, i.e. the undersigned. See Order No. 14047.
It was my understanding that the Commissioners Court of Kerr
County made me its agent in connection with the matters stated
above.
In August,' 1980, I met with Milton Wayne Barrett, the owner of
Valle Verde. At that time I instructed Mr. Barrett as to my
requirements for construction of roads known as Elizabeth Drive
and Karen Drive, in Valle Verde. The road construction was
completed about the first of December, 1980. At that time I
again met with Mr. Barrett at the subdivision for an inspection
of the roads. After making an inspection, I told Mr. Barrett
that the roads looked fine, but that I would withhold final

In November of 1985, I again met with Mr. Barrett at the
subdivision. At that time I instructed Mr. Barrett to do some
touch up work on the roads such as some blading and filling with
gravel.
I met Mr. Barrett again at the subdivision in January, 1986, and
at that time I h"a~`- him my final approval as to the roads in
question. At that time Mr. Barrett asked me for a final inspec-
tion certificate. I told Mr. Barrett that such was not necessary
because I had complete authority to - -

I ~t~-wrote a letter to indicating that
I had accepted the roads for county maintenance; however, it is
my understanding that my letter cannot be located.
This letter is to confirm the facts as stated, and to assure the
present Commissioners Court that the above action was taken and
that the roads in Valle Verde Subdivision (Elizabeth Drive and
Karen Drive), were accepted by me on behalf of the Commissioners
Court of Kerr County, Texas, for county maintenance.
