In the early years of the program, there were instances when the YL8 financed overpriced land and instances when a veteran'f name was used in transactions without his or her knowledge. Sections 161.217 and 161.218 of the Natural Resources Code of Texas state that the Commissioners Court of each county in Texas will appoint a VLB Committee composed of three residents; the only requirements for service on the committee are that each member live in and own real property in the county. The cdmmittees are to report on: - the financial responsibility of the veteran, if known - whether or not the transaction is bona fide - the reasonable value of the land • - - the credit rating of the veteran The committees may establish the method of determining the estimated value of the land and the veteran's credit record. Generally, one or more of the committee members will be aware of land values in the county and can comment from personal • observation of the market. Before the transaction is closed, however, one of our appraisers will formally appraise the land. As to the credit record, a veteran will usually qualify if he or she has a reasonabl good job, some ,job security, manageable monthly installments on current obligations and knows the amount of the semi-annual payments on the VLB transaction. A detailed credit report is dot repuired for several reasons: if a veteran had just returned rf om military service, it is not li ely"cl< that Fe or she wouldhave the kind of credit record most private financial institutions will require; our program is relatively lenient in such instances because 'our investment is protected by careful appraisal of the land and the steady increase in land values. A veteran applying to purchase land through the program submits the following forms to the county committee: (SAMPLE FORMS FOLLOW) 1. The VLB County Committee Confidential Report. This form is completed by the committee after interviewing the veteran and/or after reviewing the Veteran's Application and Contract of Sale. NOTE: If the veteran is a resident of one county purchasing land in another county, he or she submits the forms to both counties. The committee in the county of the veteran's residence is obviously best prepared to report on financial responsibility, whether or not there is deceptive use of the veteran's name in the transaction and on the credit • VLB~County Ccmmittces 'Z. record of the veteran. The committee in which the land is located is obviously best prepared to report on the roaasnahi• value of the land. If the veteran is purchasing land in the county of his or her residence, only the county committee in that county is involved. 2. A co of the Veteran's A lication and Contract of Sale. ' This form is completed by the applicant and spouse, if any) and the seller(s) of the land, and acknowledged by both before a Notary Public prior to its submittal to the county committee. 3. A coov of the Veteran's Questionnaire. - This form is to be completed by the veteran prior to submittal .._ to the county committee. 4. A coov of the land survey. _ A survey of the land by a Registered Public.Surveyor made within the preceding six (6) months is submitted for the ' county committee's review. The county committee of the veteran's residence and/or the county committee in wh the land is located will review the documents submitted, complete the Confidentia' Report and send it to the Veterans' Land Board as soon as possible.
