The City Council approved this item at their regular City Council Meeting on January 27, 1987. It is my understanding that this is the slightly revised contract as discussed by the County and City Attorneys. K CITY OF KlRR V I LLE, TEX A! Also, for your general information, I have attached a copy of Ordinance No. 87-03, affirming the status of the Kerrville-Kerr County Joint Airport Advisory Board. The need for the ordinance was recognized several weeks ago while reviewing a lease with Gibson Products for Airport premises. At that time, the City Attorney and I discovered that the City Council and the County Commissioners granted the Airport Board the authority to contract on behalf of the City and County in the early 1970's. Apparently, that authority has never been revoked by either governing body. The Airport Board in recent times has only functioned as an advisory board, as have most other City appointed boards and commissions. Therefore, we have begun proceedings to correct this situation. At their meeting on January 21st, 1987, the Airport Board members were informed on the action that the City was expected to take. The Airport Board members agreed that they had no desire to be anything other than an advisory board; and they had no problem with the ordinance reaffirming their status. Commissioner Ray was also present at this meeting and is knowledgeable on this subject. TEXAS 78028 512 • 257 • 8000 CITY OF KERRVILLE ORDINANCE 87 - 03 AN ORDINANCE AFFIRMING THE STATUS OF THE KERRVILLE-KERR COUNTY JOINT AIRPORT BOARD AS AN ADVISORY BODY WHEREAS, there has been confusion as to the power and authority of the Kerrville-Kerr County Joint Airport Board; and WHEREAS, certain prior proceedings of the City Council might be interpreted as bestowing authority upon said Board to lease land; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KERRVILLE, KERR COUNTY, TEXAS: The Kerrville-Kerr County Joint Airport Board is an advisory board only. It has no authority, acting alone, to lease, contract, convey or sell land. Any prior authority to the contrary is hereby revoked. This ordinance is effective upon second reading.
