FROM VOTING", said motion carrying by a majority vote,

residents who are concerned about indiscriminate use of firearms.
As indicated in our conversation the ordinance proposed by our County
Attorney will be placed on the agenda for discussion at our Commissioners'
Court meeting, Monday, November 9. I will ask for a public hearing at
that time.

questions you may have and will be interested in any new information
you may learn.

Enclosed please find a proposed draft of a regulation for
limiting the use of firearms. I have tried to keep it as simple
and succinct as possible. The only way that I could figure out
to allow usage of firearms ott these small tracts was to have the
Sheriff's Department approve the facilities for their usage.
I am not sure what kind of liability we would incur if the
Sheriff makes a mistake in judgment on the facility and someone
is in,~ured.
The only alternative I can think of is to either do one''of
the following options:
1. Prohibit all discharge of firearms; or
2. Prohibit hunting and/or the killing of animals on these
tracts.
Please have this letter and proposed regulation disseminated
to the other Commissioners, and please put it on the agenda for
further discussion and notify me of that date and time.

Section I:

WHEREAS, Article 2372FF, Sections 1 through 5 empower the
Kerr County Commissioners Court to prohibit or otherwise regulate
the discharge of firearms on certain types of property in Kerr
County; and
WHEREAS, the Commissioners Court of Kerr County, Texas feels
that it is in the best interest of the citizens of Kerr County to
regulate same, it is hereby ORDERED as follows:
Section I:
The discharge of firearms in Kerr County, Texae is hereby
prohibited on all lots:
1. Which are a part of a subdivieion, all or part of which
is located in an unincorporated area of Kerr County, and for
which a plat is required to be 'prepared and filed under Section
2.401 or 2.402 County Road and Bridge Act (Article 6702-1,
Vernon's Texas Civil Statutes); and
2. Which are 10 acres or smaller in the unincorporated area

Section II:
Discharge of firearms under the following circumstances is
not prohibited.
1. Discharge of firearms for the protection of persons or
property.
2. Discharge of firearms at a~~~~facility designed therefor,
such facility to be approved by the Sheriff's Department of Kerr
County, Texas.
