COUNTY HEALTH OFFICER OR OTHER PERSON DESIGNATED BY THE KERR
COUNTY COMMISSIONERS' COURT TO MAKE SEMI-ANNUAL INSPECTIONS
AT SID PETERSON MEMORIAL HOSPITAL, V. A. HOSPITAL AND STATE
HOSPITAL AS TO PROPER FACILITIES, PROCEDURE AND EQUIPMENT FOR
TAKING BLOOD SAMPLES IN DWI CASES
On this the 11th day of April 1988, upon motion made by
Commissioner Ray, seconded by Commissioner Baldwin, it was unani-
mously approved by the Court that the County Health Officer or
other person designated by the Kerr County Commissioners' Court,
be authorized to make semi-annual inspections at the Sid Peterson
Memorial Hospital, V. A. Hospital and Kerrville State Hospital,
as to proper facilities, procedure and equipment for taking blood
samples in DWI cases, as per Art. 6701E 5 Sec. 3(c), V. A. T. S.

The law which deals with blood specimens in DWI cases (Art.
6701E 5 Sec. 3(c)) was amended on September 1, 1987 to require
the blood sample to be taken at a sanitary place ins ected on a
periodic basis by the count in which the sample was taken.
As I understand it, Kerr County does not perform inspections
such at this at any of the local hospitals, which can lead to
having the Courts dismiss DWI cases. The solution to this most
serious problem should be addressed immediately.
Please place the subject of County inspection of local
hospitals on the agenda for your next meeting.
