ORDER NO. 18178 MOTION TO APPROVE CONTRACT FOR THE COLLECTION OF TAXES FOR THE DIVIDE INDEPENDENT SCHOOL DISTRICT On this the 11th day of October 1988, upon motion made by Commissioner Baldwin, seconded by Commissioner Holland, with Commissioner's Baldwin, Holland and Lich, and County Judge Edwards voting "AYE", and Commissioner Ray "ABSTAINING", said motion carried by a majority to approve the CONTRACT FOR THE COLLECTION OF TAXES FOR THE DIVIDE INDEPENDENT SCHOOL DISTRICT, by and between the County of Kerr, acting by and through its Commissioners' Court, and Divide Independent School District, acting by and through its Board of Trustees. TAX COI,LECTIUN CON`PRACT This Tax Collect_i.or- Contract made and beginning on July 1, 1988, by and between the County of Kerr, acting by and through its Commissioners' Court, and Divide Independent School. District, acting by and through its Board of Trustees: 1. Term. This contract sha:Ll begin on July 1, 1988, and shal]_ terminate on June 30, 1992, unless sooner terminated as provided herein below. 2. Tax Collections. The County agrees to collect on behalf of the School District all ad va:Lorem taxes, penalties and interest due, or which may become due to the School District during the time this contract is in effect. The obligation of the County hereunder is to bill and collect. current and deliquent taxes, penalties and interest, but the obligation hereunder does not include the obligation to appraise properties nor to assess them. During the term of this contract it is expected that such appraisal and assessment duties will be accomplished the the Kerr County Tax Appraisal District. 3. Records. The School District, without further cost, shall, at any time, be permitted to inspect and copy all records, including appraisals, assessments, bills, statements, computer tapes, any and all other material in the possession of the County in any way pertain- ing to the appraisal ar-d assessment of the District's properties and the billing and collecting the Distr.ict's taxes, penalties and interest. In the event of. the termination of this contract, the School District shall be entitled to have all such records and materials; or cop.i.es thereof, turned over to the District. 4. Te~minat.ion. Dither party may terminate this contract as of June 30 of any calendar year by giving written notice of such termination prior to March 1 of ttie preceding calendar year. 5. Disagreement on Collection of Taxes. In the event that the County elects not to t.ax certain properties and the School District elects to tax such properties, then the Kerr County Tax Collector shall be obligated to collect such taxes on behalf of the Schoo]_ District, or the School District at its election may collect such taxes on its own. 6. Compensatiorr.~ The County, as compensation for the ob- ligations assumed hereunder, shall be paid one percent (1$) of the current grid deliquent ad va_1_orem School District taxes, penalty and interest actually collected on behalf of the Sc~iool district. 7. Unusual Litigation. Reports. All reparts required by law to be prepared shall be included witt-ii.n this agreement. 9. School Distri.cl-. All taxes, penalties and interest collect- ed for the School District sha].1. each be deposited into a special account separate and apart from any other account. On a weekly basis taxes collected for the D.istri.ct, whether taxes, pe~lalties or interest (less compensation to the County) will be deposited in the District's designated depository bank in the appropriate accounts of the District. 10.
