Serving on the committee are representatives of corrm~.u~ity, businesses -- and citizens groups which have direct contact with the impact of on- site wastewater regulations. ~_ All committee members share a concern for the protection of our com- munity's ground and surface water resources as well as the protection of public health, and realize that continued growth in our unsewered viral areas utilizing on-site methods of waste disposal must proceed . -- using the best available technology to overcome inherent site limitat- ions encountered in the Hill Country. __ The committee's recommendations also reflect a strong desire to incor- porate manaaemient strategies which will keep the costs of developing on-site waste disposal systems to a minim~n. Four m?etings were held during the month of July to review and discuss Dr. B. L. Carlile's reports relative to the current status of real estate transactions involving V.A., F.H.A., and conventional loan certifications _ for septic systems. The followin3 recommendations are now respectfully su}.~nitted for the Court's consideration: G~.ide to Soil Suitability for On-Site ~~'astewater S stems - Dr. B. L. Carlile, P.E., CPSS This technical report should be adopted and implemented as an operations and procedures manual to be used with the "Soil Survey of Kerr County, Texas," in the selection of the most appropriate type of on-site tech- nology for each new and upgraded on-site system in Kerr County. The recommended property line effluent quality goal of: Biochemical Oxygen Deir~nd (BOD) 10 mg./1 Zbtal Suspended Solids (TSS) 15 mg./1 r Ammonium Nitrogen 2 mg./1 'Ibtal Phosphorus 1 mg./1 Fecal Cbliform Bacteria 200 FC/100 ml. ~._/ rr/ `r ~1d Hoc Committee Page 2 Should be accepted as the water quality standard by which a "properly - functioning septic s~~stem" should be measured. The adoption of this report will allow the irstaliation of less costly - on-site systems in areas where a literal interpretation of the texas ~oartmLnt of Health's Construction Standards waul.d prohibit anything other than the costly evapotranspiration system. _ ^bnitoring of On-Site Systems Based upon scientific research, Dr. Carlile's technical report predicts -` that water cruali ty standards can be achieved if ~:astewater is treated through at least 2 feet of aerobic, unsaturated soil material. In order to verify and/or test this theory, it is recorrr~n._nded that a monitoring _ program be implemented to measure the effectiveness of the recorrunend~ technology to determine if materials such as caliche, limestone, mall, etc., offer the degree of treatrrent necessary to protect ground~.aater in Kerr County. S`andard certification forrs require that a srecific and detailed investi- gation of the septic syst°~ b` grade to determine tY~st it can be exxpected to function pro~rly ~,it}:out creating a public h~.~lth nuisance. - _~~ t ~1d Hoc Committee Page 3 ,t On a national average, single family residences are sold every seven }Tears. tiJhen certificates of approval for unlicensed septic systems are required, the services of a professional engineer are needed to deter- . mine if the septic system "can be e:{pected to function satisfactorily. " The cost of certifying unlicensed systems ranges from $400.00 to 51,500.00. If the system is found to be in need of up-grading with an engineered system, the total cost to the individual for engineering ._ services can be several thousand dollars. It is recorrrnended that the environmental health staff provide, for a - fee, certification inspections to reduce the costs of real estate transactions involving septic system certification. ._ Program Staff It is anticipated that monitoring of on-site systems, s}Tstem design services, and real estate transaction certificates can be provided - with the addition of one full time employee to the program. Rn increase in permit and certification fees should substantially off-set „_, the expense of additional staff. Licensing and Septic System h",aintenance There has been much discussion regarding the need for septic system train- tenance to prolong system life. 'T'his carrmittee has come to the conclusion that a realistic approach to beginning a 1r~andatory traintenance program ._. caoul.d be~to re-license existing licensed systems every three years with a septic tank pl-a~-out requirerr~nt and general site inspection. The system should be re-licensed if it doesn't constitute a nuisance or public health hazard. There are 3700 licensed septic systems in Kerr County. This would in- volve the re-licensing of 1233 systems ~`r year, a function that the --- enviromrnntal health staff could realistically accomplish. In addition, it is advised that existing systems, having been certified for real estate transactions, be licensed and placed in the three year re-licensing _. program. This schedule s'nould apply to systems which have been un-graded as a result of system failure as moll. t•;ater Conservation and F~ucation The co;rmittee supports Dr. Carlile's recommendations that ~tiater conser- vation not only helps preser~,Te the quality of water in Kerr County, but -. also helps conserve the supply of water for future developrr~nt. `~ Ad Hoc Committee Page 4 The following strategies should be i~lemented to insure that water conservation measures are prc~roted in Kerr County. The design requirements for new septic systems can be ^ reduced by a factor of l00 - 15$ if appropriate water saving fixtures are installed with initial construction. This will offer a cost effective incentive to incorporate - water conservation into new hor.~s. titi'ater conservation fixtures are highly recom;nended for up- ~~ graded failing systems and may be part of permit require- m°nt5. Public education programs which stress the need for water - conservation and septic system maintenance should be con- tinued throughout Kerr County. County Wide Operations and Maintenance Program The committee feels that this strategy for on-site wastewater manage- - rr~_nt has definite rr~rit and offers the best plan for insuring that ground water and public health concerns are addressed. However, this option requires careful planning, the establishmient of specific and _ attainable program goals and above all, public support. After the effective date of these Rules, only the following types of sewage discharges shall be lawful: (1) Sewage discharged into an organized disposal system -~ operating under a valid permit issued by the Texas Water Commission. (2) Sewage discharged into a private sewage facility - designed, installed, licensed, operated, and main- tained in accordance with these Rules. (3) Sewage discharged into an existing private sewage facility that is in use on the effective date of ""` ' these Rules, that has not been substantially mod- ified since the effective date of these Rules, and that is operated and maintained in such a manner as - not to cause pollution, a threat to the public health, or nuisance conditions. §5.02. REQUIREMENTS. - (a) No person, except the person owning or having the right of possession and use of the parcel of land upon which a proposed private sewage facility is to be located, may - apply for a private sewage facility permit or license. (b) The design, construction, and installation of any new private sewage facility and the maintenance of any - private sewage facility shall, at a minimum meet the requirements set forth in the Standards. {c) No person may cause, suffer, allow, or permit the con- struction or installation of, or a substantial modifica- - tion to, a private sewage facility unless a permit therefor has first been issued. (d) The construction, installation, or substantial modifica- - tion of a private sewage facility shall be made in accordance with the approved design and requirements of the permit issued therefor. (e) No component of a private sewage facility shall be " covered until an inspection by the licensing authority has been made. Provided, however, absorption trenches or beds, or evapotranspiration beds may be partially back- - filled, but all ends and other critical areas shall not be covered until the licensing authority has determined, as evidenced by the issuance of a license, that the _ installation, construction, or substantial modification complies with these Rules, the Standards, or other special conditions specified in the permit.
