FILED IN THE 216th DISTRICT COURT, CAU5E N0. 88-190-A, be
amended, by adding the following: "and that Mr. Kersey be
authorized to use the Secretarial Staff of the County A.ttorn.ey's
Office in this matter".

Gentlemen:
Enclosed please find a copy of Defendant's Original Answer
filed in the above cause. .,
As per my understanding, I have been retained to represent
Kerr County in this matter at the rate of $37.50 per hour.` I
further understand that the County wishes me to limit my
involvement as an attorney to the absolute minimum necessary to

legally protect the county.
It is my further understanding that the reason for the
reduced rate is primarily based upon the fact that the
Commissioners Court wants me to use the secretarial staff of the
County Attorney's office. I do not know if the order passed
retaining me contained authority to use the secretarial staff or
not. You may want to consider adding an amendment to that order
or passing a second order which authorizes me to use the County
Attorney's staff in this matter. I leave that decision up to
you, but do wish to clearly state in writing that that is my
understanding of our agreement.

On this the 12th day of September 1988, upon motion made
by Commissioner Holland, seconded by Commissioner Ray, with
Commissioners Holland, Ray and Lich and County Judge Edwards
voting "AYE" and Commissioner Baldwin "ABSTAINING FROM VOTING",
said motion carrying by a majority vote, it was approved that
Kerr County retain the Professional Services of GARY E. KERSEY,
at a fee of $3?.50 per hour, to represent the County in a
Civil Suit filed in the 216th District Court of Kerr County,
Cause No. 88-190--A.
