ORDER N0. 18199 MOTION TO APPROVE CONTRACT BETWEEN CITY OF INGRAM AND KERR COUNTY ON THE "DRUG DOG" On this the 20th day of October 1988, upon motion made by Commissioner Baldwin, seconded by Commissioner Holland, the Court unanimously approved the contract between the City of Ingram and Kerr County on the "Drug Dog", with the insertion of 30 days in paragraph 1. and 100 in paragraph 6. AGREEMENT COUNTY OF KERR X X STATE OF TEXAS X This agreement made this 20th day of October 1988, by and between the City of Ingram, a duly incorporated city, located in Kerr County, Texas (hereinafter referred as "Ingram") and the County of Kerr, a Folitical Subdivision of the State of Texas, (hereinafter referred to as "Kerr"). WHEREAS, KERR is the owner of one animal (dog) named as "Zowie", said animal trained for the purpose of locating and detecting various drugs, narcotics and other illegal items; and WHEREAS, DON GRAY (hereinafter referred to as "handler"), of the City Marshall's office of Ingram has agreed, through the City of Ingram, to care f.or, handle and work with said animal. NOW THEREFOF.E, the above parties, for and in consideration of the mutual covenants and promises hereinafter found, agree as follows: 1. This contract shall be for a term of one (1) year. It may be cancelled, without prejudice, by either party upon __3~ days notice in writing to the other party. 2. KERR will pay all expense of housing and maintaining the animal, to include, but not limited to, food, veterinarian bills, etc... Handler shall submit all bills for such costs directly to county of Kerr on a monthly basis. 3. KERR hereby assumes all liability for any damages resulting from the proper legal use of the animal. Damages resulting from illegal use, negligence or other improper use of the animal shall be the responsibility of the person or entity illegally, negligently or improperly using the animal. 4. The animal shall be made available to all schools in Kerr County area on a routine and repeated basis; it 1 being understood hereby that the priority use of the animal shall be in the schools of Kerr County, Texas on an as needed or as requested basis. The animal shall not be used at any school unless an official of that school is present. The Handler and/or city of Zngram shall execute a letter of agreement with each school for the purpose of outlining the procedures and policies to be followed in conjunction with the animal's use. 5. The animal may be used for any other educational or law enforcement purpose, so long as that use is legal, proper and secondary to the animal's use in schools. 6. Kerr will contribute and pay 100 percent of handler's reasonable expenses incurred in use of the animal, such bills to be submitted on a monthly basis to Kerr. KERR COUNTY Danny R/. Drug Dog Contract 20 October 1988 Ken County owns the Drug Dog. Registered in County Judge Danny Edwards name. This is due to requirements of the American Kennel Club that specify registration in an individuals name. Dr. Bill Hoegemeyer, DVM, will provide an annual check-up/physical, to include vaccinations (DHLPP, & Corona), at no charge to the county. All other professional veternarian services will be billed at twenty- five percent (25%) discount. Need to establish Line Item under County Sponsored Activites to cover associated costs, i.e., medicine, food, mileage, etc.
