FUTURE SUPPORT Approval of the above entitled and numbered grant does not commit the Governor's Office to future funding. Any future funding shall be determined by the state plan under which application may be made, all applicable policies and procedures promulgated by the Governor's Office, Criminal Justice Division and the appropriation of funds GRANT ADJOSTNENTS Grantee shall submit written requests for grant adjustments, as required by Criminal Justice Rule number_3.65, provided with the grant application kit. 1. Grantee shall comply with the following: a. Section 51.12(c)(3} of the Texas Family Code, regarding recognized professional standards for the detention of children. b. Sections 223(a)(12), (13), and (14) of the Juvenile Justice and Delinquency Prevention Act, regarding removal of juveniles from all adult jails and lockups in the county within six hours; sight-and-sound separation of juveniles from adult offenders during any period of incarceration in an adult jail or lockup; and removal of juvenile status offenders from secure detention within 24 hours after being taken into custody by law enforcement officers. Exceptions are allowed for detention on weekends and holidays. Under federal rules, status offenses include runaways, truants, and juveniles taken into custody for simple possession of alcohol. 2. The Center provides an alternative to the use of adult jails for juvenile detention in Kerr, Bandera, Kimble, Gillespie, and Kendall Counties. An estimated 100 juveniles will be supervised under the project, with an average stay of six days. A standard condition of funding will be compliance with detention standards set forth in Section 51.12 of the Texas Family Code and compliance with the federal Juvenile Justice and Delinquency Prevention Act. Indicators of Goal Achievement will include total number of juveniles referred, juveniles diverted from detention, juveniles detained, average daily population in the center, average length of stay, and number of juveniles provided counseling and educational services.
